CCA Advice please.

Hi guys, (This is one of my first posts, so please be gentle!)
Love the forum, what an upbeat, supportive bunch you all are! I hope to help out others similarly when I get a bit more experience myself with all this stuff!

Brief history of me...
I have (stupidly) run up debts of about 23k and have been on a DMP with CCCS for the past 3 months. A few credtors have accepted the payment plan (M&S cc, RBS loan - passed on to a DCA & they're fine too), there there are a few others being especially awkward - Halifax, Egg and Lloyds to be precise. I'm paying off as much as I can, but apparently it's not enough.


I have been flicking through the forum for a few days and seen a lot of threads about CCA requests. There's so much info to read from so many different people in loads of places that I'm getting myself confused with the whole affair.

Would anybody be able to fill me in a bit on the whole process please?

I assume I send a CCA request to my creditors using the great letter on this forum (here) and then wait? What happends next? What if they fail to produce it? Also, how to I send them £1 for the CCA documents, a pound coin the envelope? (I don't have a cheque book) and do I send it recorded delivery?
There's also a list somewhere of what a CCA should be, the info it should contain... anybody got a link?


I've just read that back and I sound like a rambling loon! I'm sorry, I have so many questions going round my head, I'm being harassed (mostly by Halifax & Lloyds)... I'm a bit all over the place. I also find I'm conflicting morally with myself. The debts are mine, I took out the loans/cc's so it's my duty to repay them in full, but a CCA request seems like a pre-cursor to not paying the full amount. Having said that, they continually upped my CC limit, gave me new loans etc. knowing full well the problems I was getting in. Now they harrass me, adding charges etc. and I just feel like fighting back! Argh!

Anyway, ramble/rant over... If anyone has any info/links/advice it will be gratefully received!

    Send the first CCA letters to all of your creditors, using a postal order if you don't have a cheque, then sit back and wait. If nothing appears in response you send letter two. If they can't find the CCA legally interest is frozen and the debt is unenforceable. I think you can then just make token payments of £1 and let them chase their own tails!

    Worry about whether the CCA they send (if they produce one) has all the right 'bits' at a later date. You can scan it and post it up on this board (minus private info) for the resident experts to check if you aren't sure.

    OK, thanks for the advice. I've sent a letter to Halifax today telling them to stop harrassing me by phone and only send letters, so hopefully that'll have an effect.
    I'll do the CCA's when I have a chance!
