Ex not paying morgage

Hi I recently split up with my ex and he is refusing to pay his contribution to the morgage. Does anyone have any idea where I stand legally?

    well in real terms you need to decide where you are going
    you cant have one paying for a mortgage and not living there
    so either buy them out,sell up and split profit/loss
    or get a lodger and use it to pay the mortgage shortfall and sort out the remaining equity with your ex
  • I have been going through this for the last year and a bit!!!

    Although your ex is legally responsible to pay his half of the mortgage, getting them to accept this responsibility and pay is something else!! Inform your mortgage company asap that you are the one solely paying the mortgage...you will prob find that the mortgage company don't really care who is paying, as long as it's paid, but it will help down the line if things get messy and worse case senario, you end up in court with your ex. They keep notes on their systems. You can then refer to them for dates etc. Also, if you need to take the mortgage on yourself, it is all ammunition that you can physically afford to pay it, and have been for a period of time.

    And like the others have said, start to keep an audit trail of your payments to the mortgage company - bank statements etc.

    I would also advise to keep a diary.......might sound a bit sad, but trust me, again, it will help with dates, documents sent, payments made, conversations had. Again, all ammo should you need it.

    In my situation, i have worked out how many missed mortgage payments there are, and deducted it of his share of the equity in the house. I have been to sols who have never knocked my theory!

    Remember things can turn for the good / bad very quickly when emotions and money is involved. Hope this helps and best of luck to you.

    Yes, if the full mortgage payment is not made, both of your credit ratings will be destroyed.
