Basicly a creditor debt collection agency has to supply you with a valid cca once requested and it must be with certain prescribed terms on it to be valid. If they cannot produce this within 12 working days the debt is in dispute and cannot be enforced until they do produce a cca.

So can I ask for these over the phone and also try and settle with them on the phone????
  • Get any offer in writing before you part with any money. Make sure they agree to mark your credit file as "satisfied" and that neither they, nor any 3rd party or any associate will chase you for the rest and that you are released from any liability.

It is important to get this in writing. As I said, National Debtline website has a good letter that you can send.

No NEVER speak on phone ,deal with all financial matters in writing only.

Im putting a link in with various letters you can send http://forums.moneysavingexpert.com/showthread.html?t=963087

Remember always keep copies of letters you send and also send them 1st class registered .You will also need to send £1 to request a copy of your credit agreement do this via a postal order and not cheque as there have been reports of creditors and debt collection agencys copying signatures for there own gain.
