My friend has had to put her house up for sale due to ex husband refusing to pay his half of the mortgage and if it doesn't sell will be reposessed, think she has about 3 months to get a buyer. Its on the market for £145,000 but only needs £120,000 to clear mortgage, fees etc she is willing to accept £120,000 from us to buy it for her to rent back (he doesnt know this) but he wont sell for less than £145,000 highly unlikely it will get this what can she do to stop it being reposessed. Can she go direct to the mortgage company and say she has a buyer and can they make him accept or is she destined to be in debt and homeless cause he wants to make a few quid.
The only hope on the horizon is they are due in court mid march can the judge make him sell.
The thing is he is very pig headed and just wont do the right thing, theres no reasoning with him, as he signed the paperwork in court in december to agree to pay half the mortgage and money for his son and has only made 1 payment and refuses to pay again.
