My employer uses flexible working. My normal hours are 39 but sometimes they make us work 34 hours. They still pay us for 39 hours. Later they make us pay the hours back i.e. we work 44 hours and get paid for 39. Is this legal. If i work 34 hours can i ask them not to pay me for 39?

It keeps your pay steady and simplifies their pay processing.
As long as over, say, a three-month period things even out, why would you want to have a fluctuating income?0
