question about my legal standpoint

I posted yesterday regarding my issues with Barclaycard and them selling my debt.

I just receive a call from 1st Credit regarding my outstanding balance. This is the first I have heard from them at all. (no previous calls, no letters) They asked for the complete balance in the one go as the debt has been sold on and then said they were willing to give an out of court settlement. (it isnt at court, no papers have been served etc even although I just got warnings on the phone about I would lose the case, get costs added on etc)

When I informed them of my situation and my willingness to send in my income/outgoings as sent to my other creditor they told me that wouldnt help. They then told me to pay half of my balance in the one go. I told them I cant raise £1800 in 5 days..this was then cut to £1500 which I still cant pay.

The call ended by them telling me to contact them by friday with that payment.

My situation is I recently lost my own business and I am in the process of applying for Jobseekers Allowance while I get employment.

So where do I stand? Can they insist on money I cant afford? Should I have received things in writing from them?

  • I should also add during the conversation I was asked if I could raise the money from elsewhere to pay the debt off to them. Am I right in saying this is against the rules by encouraging someone to get into debt elsewhere to pay off another debt?

    Do not be so nice to them. Do not get into detailed discussions about your personal circumstances on the phone. Be civil but reiterate that you can only pay what you are paying already. If they get into a strop with you ( and they probably will) then end the call and insist they communicate only in writing. If you scour this site carefully you will read lots of horror stories about this particular organisation. I think debtman2007 could tell you a thing or two, as can several others.

  • Arm yourself ready by studying other causes within the forum.These people who phone you up have not got a clue to the side of the law and will always tell you different.You will find some great letter templates on this site and when you put them into action you do get results.
