                    I am all set for going BR now and have got my head round it all and all paperwork sorted when a nightmare has just come into my brain yet again.
I was claiming Incapacity and went on the new scheme of getting people back into work while still claiming and being able to earn up to I think 80 quid a week. This also made it possible for me to pay the IVA we are in but didn't tell the IVA company.
My problem is I also told tax credits I had started work but didn't tell them I was still getting Incapacity.
If the OR goes through all this will he/she also do me for fraud and I could also have hmrc on my back couldn't I???
I have been so worried about this I have now told hubby everything is on hold again, we are in enough trouble without being in more due to my stupidity.

            Thank you for that. I suppose it comes from reading other peoples posts. I read that the OR can go back through your past up to five or more years so thought all bank accounts and incomings would be investigated along with the credit side of things.:rolleyes: Money Talks ...but all mine ever says is Goodbye! :rolleyes:0

            No, they're interested in what you spent your money on and how you got into debt, they'd only look at money coming in if it looked suspicious, for example if it looked like it was salary from someone you hadn't said you worked for. TBH, I don't think they would have a clue what benefits and how much you would be entitled to.Accept your past without regret, handle your present with confidence and face your future without fear0

 Have you asked the court if they require failure notices? we did not need one. Just a thought in case you started to worry if they don't turn up in time. Not all courts require them.

            Hello,
 I have found this info on our renewal information we've been given, which in our case related to JSA immediatley after br. If Tax credits was already in place, prior to going back to work and you did not tell them that your incapacity had stopped it should still be part of your claim. Have you checked your last award notice? Ours says on the bottom of the second page *to*date, Full entitlement due to received JSA.
 This is on the information I have but I think it is also on the main TC website
 "When you're making a claim for tax credits you'll need to enter on the claim form any state benefits you get that are taxable, such as:- Incapacity Benefit - only include benefit paid after the first 28 weeks of incapacity together with any Child Dependency increase. Don't include benefit paid during the first 28 weeks of incapacity. If any tax was taken off your benefit, include on the claim form the amount that was due to you before the tax was taken off."

            Thanks Jenni I know the awards were incorrect just did nothing about it as we were struggling to find the 300 per month for the IVA. I just didn't want the OR getting heavy over it, if I have to pay it back then that is something that I will face when I come to it. Roll on BR I just want it all over now and preferably before we go on holiday.             know the feeling well re IVA's! OR wont get heavy over it. But do look into whether a overpayment debt could be included, if sorted you wouldnt have to worry about it after br. I am sure they are but cant swear to it;

            Off to Tunisia. Booked it last feb so expected all to be ok at time of booking. We do book it like that every year and take the year to pay for it monthly like a saver club and dont miss the money.:rolleyes: Money Talks ...but all mine ever says is Goodbye! :rolleyes:0
