argos faulty leather sofa help needed

I am in need of help. I bought a leather sofa just over 18 months ago, however a afterabout 4 months i noticed water marks appearing. I also read in the newspaper about a faulty batch of leather sofas that had become water damaged. i called argos and after a while they sent out an upholsterer, this was just under a year ago. He said the marks should not re-appear but if they did to call the company back. I know it has been a while but the marks returned before xmas and worse than before. Due to circumstances of being a carer, my sofa has hardly ever been sat on (nearly always with my mother). I have called argos again only to be passed to the upholsterer, who said that his work only lasts for 3 months and it is up to me to call in an upholsterer at my own cost to assess the marks !! can they do this ? it was well publisised at the time and i took the appropriate actions at their orders so where do i stand? i have bought a sofa that was faulty and it still is despite their attempts to get rid of a water stain. Can anyone help who can advise me on what to do next? i dont have the money to get in an upholsterer. does anyone know any trading standards or if this would apply? many thanks

Firstly, the only faulty batch of sofas I am aware of are the ones that customers had an allergic reaction to (including my husband), they were nothing to do with water marks.
Secondly, if a fault appears 6 months after purchasing it is down to the customer to prove that the fault is due to a manufacturers defect. As the sofa is now over 18 months old I would say that they are within their rights to request that you supply an assessment from an upholsterer to prove the fault is due to a manufacturers defect.0 -
but when i first complained it was under 3 months. secondly, it was an article in the sun (and mirror i believe) regarding the sofas being made in china and getting damaged. if i can find it online i will post it. as far as im concerned, they knew from the off and it has nothing to do with the faulty sofas you mention, these were their replacements!A happy wife, and mum to 2 lovely little boys :j0

Having just won a fight for a refund for a pair of shoddy Argos reclining chairs I contacted the lady below:
Sara Weller (Managing Director I believe)
Argos Ltd.

I was also affected by the sofas from China (I think I'll steer clear of Argos now!) but they were not water damaged they had a chemical in them that was supposed to inhibit mould growth in transit, but infact caused skin burns.

I wouldn't be surprised if once you get a reply from the letter you're sending to the MD instead of going through customer service that you'll be told the exact same thing that CollieFrog has told you. Which is in line with relevant consumer laws.0

i imagine somewhere in consumer laws it states that items must be fit for purpose and not damaged. they were told within 3 months that the item was faulty and they failed to correct the damage.A happy wife, and mum to 2 lovely little boys :j0

I also had a leather sofa that was faulty but luckily it was after a few months and after it was assessed it was replaced (albeit not with a leather one again as I was worried about it happening again).
With regards to the above comments, I also contacted the above person regarding a faulty xbox 360 after having no joy at the store of purchase. I quoted 'fit for purpose and reasonable time etc'. She was most helpful and ask for me to sent it to her, she refunded the postage by cheque and the full cost of the product in vouchers.
I would definititely advise writing directly to her and wish you the same result as I had.
