Capital One/Debitas

My partner has a Crap One debt which now appears to have been transferred to their in house debt collectors.
Our latest correspondence with Capital One (sent as usual by recorded delivery) stated that we were only to be contacted in writing. Now that Debitas have the debt they are telephoning us.
Should we assume that they have the file and are ignoring what we have stipulated and if so can we have them for harrassment etc. We are so fed up with this company and their unrealistic demands that we have practically begged them to take us to court but their response was that they have to
pursue all alternative methods to recover the debt.
This is the only company that has consistantly ignored all correspondence including SOA's that we returned and sent subsequently in duplicate by recorded delivery - can see we are going to have engage the use of a whistle if they persist in phoning. Either that or change our phone number which I'm reluctant to do.

    Have you asked them for a copy of your CCA. It's unlikely they may either have one or that it's correctly drawn up. But depends when you took the card out.

    Afraid, Debitas will carry on unless you block their number physically. You should never change your number for example. Causes all sorts of inconveniences for you anyway.

    Oh, Debitas has no more clout that Capital One does. Just to mention that cos they are just the collections arm of Capital One, nothing else.

    And the reason I advise people to request a CCA - just like thousands of others out there have done on advice from forums like MSE - is because it is a negotiation tool.

    Glad someone else is having the same trouble, though. With correspondence. Do you find they don't make sense one letter to the last and obviously aren't chronological?

    Erm yes. They are at the same address as Capital One so same building, next desk up from where your file was yesterday. I'm being serious BTW. :D
