Hi All,
Hope everyone's ok today.
Today we got a letter from link financial saying ge money has assigned this debt to them, any debt we owe is now due to them. lm getting to grips with all this now and l want to deal with it before we get to the court stage.
(You must think we're awful, we seem to get a different problem every day!)
What lm asking is, shall l request a cca from link so we can at least delay the payment a bit until we know what money OH is going to get while off for his operation. We do owe the money but are trying to get the amount reduced by requesting a refund of charges. lf they took the charges off we could probably pay it in 2 halfs.
What do you think?

Re the CCA. I would request it anyway because Link shouldn't be demanding paymenf from you without it and it's not legally transfered to them unless they have that piece of paper. Then, as you say, it will also give you time to come to a reasonable repayment plan with them but means you have that as a negotiation tool. When said and done that's all this all is.the payment a bit until we know what money OH is going to get while off for his operation.
Oh, definitely, I would in that case you really don't need this right now (((NOVA))).
Then wait it out see what they provide. In theory, but not often practice, it should either go back to the OC if no CCA or they should say that in writing. Trouble is, it would get sold on to a never ending stream of agencies but least it diminishes things. From reading elsewhere, it is unlikely - but they may - take anyone to court without a CCA because it could blow up in their faces with a judge who would utimately then decide whether or not. I have read of some people's debt being wiped out because of poor record keeping for example.

Thanks, l shall get the letter off tonight, trouble is with me, is l just could'nt face anyhing before xmas and now lm getting a grip! like l say l want to pay what l owe but just need to buy a bit of time.

I understand fully ... you are where I was one year ago. Not until I found places like MSE or CCCS it made me relax more. Oh, one thing. Might be best you hold off until Monday to send the request cos it's the weekend. It takes 2 days off you see 'working days'. They don't give us reasonable time for example, and in some cases backdate letters when they posted them yesterday ... giving us 2 days to cough up money we cannot give them for example when it says 10 days on the letter.Any help, opinions, views I may hold those are my own. Well, I have in one sense but unfortunately it's going to be like an anchor around my neck for an indefinite period for the time being. I used to have lots of money you see so I could have cleared my debts in five seconds today if still had it. Foolishly, I took cards out when I never needed to. And now struggling. But with support you will feel a whole lot better. I've done most of this stuff myself, only because avenues like CAB have been closed off locally or it's not as easy to get debt advice as some imagine.
And hope. You put it wonderfully succinctly there when I take sentences to explain myself.
I like to give people hope because that is often all some have. I know it's all I have, keeps me going. I know tomorrow is going to be the same as yesterday, last week, last year, next year etc but you have to have something to keep you going in life. Or what's the point?
