How about this as a reply to my ex boss, or am i best not to add the last , bolded' bit

Thank you for supplying the information in your letter regarding my property. This has been passed on to my accountant who looks after my tax affairs. As requested when I am required to do so, I will be more than happy to offer assistance to your local tax office and other interested parties regarding the information you have made me privy to whilst in your employ.

No – don’t like the bold bit. I would put, however: ‘I trust that you will be in a position to provide me with any additional information as required by either HMRC or my accountant in the near future’. That should please him no end. Just remember, though that any correspondence is liable to come before the tribunal.

On the £3k front – I am not sure that you understand the process. I believe that that is what you believe that you are owed by your former employer but you are missing the whole point of a tribunal – damages. A quick example of one I finalised recently:

Employer has employee off sick – entitled to 28 weeks statutory sick pay after first three days. She is also entitled to six weeks full pay and twelve weeks half pay under the terms and conditions of her contract – he pays her six weeks full pay and 21 half pay – much more than her entitlement. She took a case against him citing fifteen reasons – all of which were unlikely to be proven. He had no hope of winning the case, however, as he failed to pay her anything in the last week when she was entitled to one week’s statutory sick pay. This is a breach of her employment rights – settled out of court for £2500.

If he failed to pay you the correct redundancy pay and notice pay you are entitled to compensation for breach of contract plus what is owed to you. Personally, I would be looking at a much higher figure. Also, people are not made redundant – positions are – check that you have not been replaced.

Finally – you do not need an accountant – you need a tax adviser. This really is fairly simple fare for most of us in that field. I cannot tell you what I would charge but I believe that, realistically, it can be achieved for £1k - try negotiating up front.

I agree - a Chartered Tax Adviser would be suitable.
  • Best way to find an accountant/tax adviser is to ask around close family and friends. People will generally tell you whether they are happy or not. This seems a quite straight forward case but the part that your accountant will play is negotiating any penalties down for you if possible. Also make sure you do not have any other skeletons left in your cupboard for that tax year in case you do get an investigation opened up.
Also get fee agreed up front for dealing with this and avoid anyone who won't agree a fee for preparing the necessary letters/returns
