Can't supply Statements!!!!

I am reclaiming the charges on three cards taken out with GE Money, I have requested the statements but they have written back and said they cannot supply them any earlier than 2005 and the ones from that date are very haphazard and not a true reflection on the actual charges I have paid, where do I go now? :mad:

You remind them that you have made a subject access request which is a request for all data they hold about YOU (the subject). This is not limited to statements, so whatever data they have, they are obliged to disclose it to you.
The 40 days deadline still remains from the date of your original SAR letter.
If the data they hold turns out to be inaccurate, then that'll be another bridge to cross, but let's just get the data first.0 -

Isnt there a "follow on SAR letter" for this?
If you feel you have not received all that you should have ??
Have you tried calling the Information commissioners office (ICO), maybe they can direct or give some advice on this.;)

Dear Sir/Madam,
I am writing further to my S.7 DPA Subject Access Request letter sent on xx/xx/xx. Enclosed with this request was statutory £10 fee.
As you will be aware the Data Protection Act states that you must supply this data upon demand within a reasonable timescale, a maximum of 40 days.
I find your recent explanation that you are unable to supply statements further back than xx/xx/xx unacceptable. You remain obliged to disclose to me ALL DATA you hold on file about me. This includes data pertaining to transacions and is not limited to statements as you should be vety well aware.
I would also remind you that you have until xx/xx/xx to comply with this request. Your continued failure to comply with this request would be a breach of DPA regulations and would result in a complaint being made to the Information Commissioners Office, and legal action to force disclosure together with damages at the discretion of the court.
I trust that such action would not be necessary and look forward to receiving the information as requested before the 40 day deadline.
If you no longer hold data beyond xx/xx/xx (2005 in your case), I require a signed declaration from your data controller and a copy of all documents pertaining to its proper disposal.
