Panic Records - Order not received, not replying to emails!

Hi,
On 4th Jan 2009 I pre-ordered a CD package due for release on 3rd Feb 2009. It came to around $50.00. I got my confirmation email and it said I would be emailed once my order was shipped out. It is now 20th Feb 2009 and I've heard nothing, nor received nothing. I've tried emailing the company twice but have heard nothing back from them.
I paid by PayPal and just now I tried to open a dispute on PayPal to get my money back, but PayPal said my transaction isn't eligible to have a dispute filed. What is going on and how can I get my money back?

Don't you have to wait up to 28 days for delivery, what did the small print say?

Does say 1-3 weeks:

When will my order ship?
I try to process and ship all orders within a day or two after I receive them. Panic Records is very small...actually, Panic Records is one person...with that said...you should expect your order within 1 to 3 weeks after placing it.

But allow for any delays as it's coming from USA
