PPS21 for non farming dwellers

Just wondering are there many people out there who are not of a farming background and are looking to build on their own ground.
I was born and brought up in the country and my parents (not of the farming community) have more than enough ground to build a house upon for me and my husband to be. My mum and dad would say that the reason they acquired that site 30 years ago when he got married would be the view that any kids he would have in the future could build and live beside them. The very week he got planning permission forms PPS14 was announced in 06. We are met with a blanket no as we don't fall into any of the criteria in PPS21 ie. active farm, farm diversification, replacement or abandoned building.
I know in the South of Ireland that a working group are in operation where applicants can apply for planning permission based on kinship. I was speaking to a planning official yesterday at one of the info meetings and he said this would probably be our only hope (if it ever happened here)
Just interested to know thoughts and opinions.

    If they allow anybody with a relative in the countryside to build, the situation will be little better that it was before PPS 14.
    Instead of looking at what's going on across the border, I would suggest taking a long drive through most of rural England and note the lack of houses that look less than 30 years old. In fact, many of them may be but they have to be built exactly in keeping with the local style so you would be hard pressed to notice the difference.
    If only that had been the case here.

    Yeah if only. I see what your saying but do feel hard done by that I can't build in the country beside my parents while for eg. 2 girls down my road can, simply because they are from a farming background.

    If you can hold off for a while you could be able to. To be classified as a 'farmer' you will need a business ref from DARD and be able to provide six years evidence that you have been running a farm business. I don't mean you need to go out and buy a load of cattle but if you are inventive this may be your only option. Another thing to look at is whether your parents have been receiving a single farm payment, they would probably get this if they rented land to a farmer.... thus your land has been used for farming purposes. I am not suggesting you lie to the planning department in any way but these are options that you should consider and you can be honest when providing evidence to support your planning case. It may take a while but would be worth looking in to. I would suggest you contact a reputable planning consultant asap and ask their opinion. You will not ever get a site based on kinship, think of the precedent it would set.

    The site would not be suitable or appropriate for farming so we couldn't go down this avenue. Not sure of exact measurements but no more that 3/4 of an acre.

    Looks like you may have problems! I would still advise you to go to a good planning consultant and get them to submit your planning application, that way if there are any problems with planning they can deal with it rather than the planning service contacting you. They will probably be able to give you an indication as to whether you will get the site passed also.
    I am not aware of you personal circumstances but if your parents require care you may have a 'need' to live in the locality based on this however this does not mean you would get the site passed either. After all that and if you get turned down by planning put in for an appeal, again this is another costly item but if you get a site passed it would be worth the cost.
    I would think that the negative factors are against you as your site is only 3/4 acre, if this is beside an existing house in the country it probably mean the planners will say you are creating a ribbon development, building a single house in other rural area and many other silly legislation points!
    If you look at the planning appeals webiste pacni.gov.uk and search for your area eg a road or town name you will get a list of appeals that have taken place. Make a note of the planning consultants who have done those appeals and get in contact with them. the likleyhood is that they know the area well and could give you honest advice. I hope you get your site passed!

    can i just add that even if you are a farmer you dont necessarily get planning permission. My brother has a field (not a site unless its got permission!) and it had planning permission about 10 years ago and he was going through the process of get the permission renewed when the new rules came into force and his application was rejected and he's a farmer.

    nadnad fully agree, my family have been farming for many years and planning permission has been rejected. After the new planning laws came in very few ppl got permission, and those who did decided to sell their sites for excessive amounts of money!!
