Certified baliff or not

Had one turn up today and he didnt even speak english, he did however hit me for an aditional £200 for missing a payment and them having to come out. Funny thing is payment isnt due for another 12 days....` is a debt being handled by bristow and sutor for unpaid parking fine and council tax

  • As far as I know ... did he show you a certified licence, eg a bailifs licence? Any form of ID at all.

There is a process that legally has to be gone through for a COURT appointed bailiff. Such as going to court first, then having a court order for them to collect.

It would help if you named the company concerned. And I am sure others here can tell you if they are bailifs. Because some DCA employes act as if they are. Sorry, but they do. Which is why it's important to determine a few things.

Ah, I see unpaid council tax. For that to happen you must have received at least a final notice from your council? Everyone gets letters without any difference throughout the UK for example. So, have you had such letters eg a default before court action?
Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.
  • bristow and sutor

This them? But the documents I mentioned are relevent also. The correct paperwork must exist. Did they have a court assigned letter. I mean not a photocopy of something that looked liked one. I don't know too much about how bailifs operate but I do know the basics behind what must happen before they get involved.

  • I'm not being impatient for one second but I take it you do want help with this? As you have bumped it to the top in the last 10 minutes? But, if you don't want to take help from me but someone else here ... that's okay with me. I will spend it elsewhere giving people help who want to genuinely accept it. And it's now time to go and cook food anyway. Hope you get help anyway.

  • is an ongoing issue and has been for some time, this is just the latest in a long line of visits by them, the door wasnt answered to the baliff however they are trying to use a walking goods agreement that is under dispute for various reasons... the paper work is laughable but outlines the additional charges added for todays visit to sieze goods plus cost of van plus 2 staff...

the paperwork is also signed by the baliff giving me his name, i just want to see if there is any way of checking online if he is certified as he must be by law to retrieve council debts ergo if he isnt then he cant legaly of come here to sieze goods and there for cant charge me for doing so

  • Very well, I typed whilst you were responding. I am sure someone will assist with that re online checking. I can't say for certain but on another consumer forum someone mentioned there may be a way. Hope you get it sorted and apologize for how I sounded.

The following website is from one of our regular posters, Herbie21. Although it is a company website, you will find some excellent advice:

    http://www.bailiffadviceonline.co.uk

This lists the fees that can be charged.

Please note that a lot of the so called bailiffs who have been visiting people recently are not registered and if this is the case, you do not have to pay the fees.

if you PM Herbie21 with the names of the people and the company name, she can check if they are allowed to charge the fees.

Even more important, I think you need to list for Herbie21 in the pm the whole history of charges as I suspect that a considerable amount that you are being charged is wrong
If you've have not made a mistake, you've made nothing

    Hi

You may note that pepper is a relatively new poster?

The response time on DFW is so much faster than on most forums that they are very surprised to find answers after the first refresh.

It may be frustrating (believe me) but people do not generally realise when they first join MSE that they need to refresh their screens to see answers, so wait for the automatic refresh to click in.

  • thanks for the link and advice ras, ive had a good hunt through the site and sent the pm as suggested but theres no joy yet, just sick to death of these spiraling debts, its actualy at the point now where the charges have trppled the orriginal debt... if i ever find the way to check these baliffs qualifications im making sure it gets stickied- there is nothing anywhere about this but for all the other security roles such as parking wardens etc the sia govern and keep a searchable database... never thought id say it but why cant the sia govern these guys too?????
