Hello this is with regards to my girlfriends job, she wants to just leave it but im not very happy about it. She was recently signed of work with stress, she gave the doctors letter to her employer and within a couple of days there was a letter recorded delivery saying they don't have a full time position for her. She had recently finished a 3 month probationary period in which the company then extended by a further 3 months when this happended. I didn't think this was fair or right to do what can she do? can she claim against them? or is best to leave it like she wants to! If anybody knows anything about employment law can the please advise me on what to tell her because she is struggling to find a new job and bills are coming in now thanks for reading. Biggy123456789

How far into the next three months was she?0

Sadly, there is probably little that she can do about it, Probationary periods actually mean so little that "passing" or "extending" them means squat.
What they have done is mean and immoral but she will not be protected in any sense until after completing one year with them and she is a ways from that isn't she?
If the job is making her feel ill, it's not one that she wants to stay in I suppose - esp. after the way they are treating her now with the recorded delivery letter/no full-time positon blah blah bullsh1t - BUT I know that there are bills to pay etc.
Guess I'm not much help - have a squiz at the Money Saving Old Style and Debt Free Wannabe boards as they may help you to find ways to cut down your expenses so she doesn't have to be in a crummy job anyway and can gather her health and confidence and find a new job at a slower pace.
Just my thoughts.

Her best bet is to find something else.
If she could demonstrate that she was being badly treated because of her age, gender or ethnic group then she might get a few bob, but going down that route would involve massive stress.0 -
Hi
If she is having to go off sick with stress in the first few months, I don't think the job is right for her anyway. Even if it was, then the company can dismiss with no reason at any time within the first year.0 -
If she was on a 3 month probation which was then extended by the employer - it would have been extended for a reason i.e. she was off sick or she didnt meet expectations and therefore they have given her a little longer to prove herself. If she is already off with stress, then it is obvious that the job is too much for her and that she should leave.
Sorry if this sounds harsh but she is not likely to get anything in a tribunal because she hasnt been there long enough and the employer can get rid of her at any time during the first 12 months of employment.
If she suffers from stress, then she needs to learn some coping strategies which will help her when she gets other jobs.0 -
Like others have said, sadly there is no recourse during a probationery period or even within the first year of employment. Additionally if she is stressed then fighting it is the last thing that she needs.
A lot of the time family members/partners see this happening and want something to be done about as they feel protective of their loved one. However, ultimately it's not them that will be fighting it and often the person concerned cannot cope with it.
Is she stressed because of the role or as a result of other things in her life? If it's just the job then it's not right for her. If it's other things then that needs addressing anyway, before she looks for something else.0 -
Ok thanks guys for your replies as you mention Red_Elle it is because I feel protective because they way it has been done is very wrong and it upset her. she is stressed due to money worries not the job but i think you are all right just out it behind her and look forward and get on with her life. thanks again0

Biggy - if your g/f is stressed due to money worries point her in the direction of the Debt Free Wannabe section of this forum and ask her to post her SOA (Statement of Affairs) https://www.makesenseofcards.com/soacalc.html (she will be able to select MSE and copy and paste it into DFW) and the folks over there won't pass judgement and suggest ways to cut back and to deal with her debts.
