    Read this

The relevent bit is weller711's post on page 2. She is CCa queen but taking a bit of time out.

You would need to remove the reference to legibility, but the rest would pretty much do for you.

post up the draft and let folk check it - GeorgeYUK and fermi in particular.

    thanks ras

Also I did forget to mention because it as made me quite ill today that I rang the financial ombudsman regarding the matter of the CCA , do you think I should leave this matter with them because they are sending me complaint forms to fill out, or do you think I should also send this letter to 1st credit as well?

I look forward to your reply

    Thanks

See what happens with the FO. If that does not work, you know there is another letter here.

    Keep well.

    Hi Ras,

Thanks so you think its best to leave it up to the FO and not bother replying to the above letter I recieved today?

    look forward to your reply

    thanks
  • I would be wary of relying on the FO to help sort this, I reported Barclays in October last year, it was only assigned to a person in January, and I have heard nothing further from them, apart from a couple of emails acknowledging further documents sent to them.

I have sent my default letter to Barclays as well as having the FO involved, but my circs are different to yours but didnt want you to think that the FO was speedy! I have also seen others posts on here where they have said that the FO offered no help in pure CCA claims.....

Good luck with it and sorry I cant offer any more help

It appears that the lovely Audrey ( Shim Quee ) has been replaced/assisted by a Mr Mike Hawker.
He, however, does not seem to have a full grasp of the Terms of The Consumer Credit Act and is also under the inpression that the Collections Staff are there to 'advise' 'encourage'etc and that they would NEVER EVER do anything outside the OFT Guidelines.

Nooooo! They never do anything outside OFT guidelines! They are soooo nice!

Incidentally, they are still advertising for staff to "negotiate" in a sympathetic way! :rotfl: :rotfl:

It was Worst Crudit that put the phone down on me when I spouted all the rules of the OFT guidelines they were breaking - basically all of them - and that I had the call recorded (I didn't) but it got the patronising, 5 year old sounding girl off the phone and I've not heard from them since! They've also still not gone to my mum's house to remove her stuff to pay for my debt as they said they would and that was a year ago - they better get a move on as mum is about to move!

Oh, how I love Worst Crudit.

Sorry to sabotage your thread - just need to rant about them!
Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free :)
