Before proceedings are issued both parties have to follow the personal injury pre action protocol, which is basically put in place to avoid the need for litigation. Have now been told that the case will go multi track and the other side require a medical examination by an expert of there choice after reviewing my medical records.
All seems to be moving along at quite a pace, other side have agreed an interim payment, this will stop us having to go down the DMP route for a few months at least.
Been unable to speak with my solicitor this week as shes,s in court all week any idea what fast-track entails?0 -
Small claims, fast track, and multi track are essentially the three classifications for claims. The multi track is for the most severe cases. The fast track is, as I'm sure you've figured out, for cases that are more severe than small claims cases, but which are still sufficiently low value that they can be dealt with reasonably quickly.
One word of warning is that whilst multi track cases can move quickly on occasion, they by default take longer than small claims or fast track matters usually. So don't pin your hopes on a swift resolution. Things could take a little while yet, but at least you have the interim payment to tide you over."MIND IF I USE YOUR PHONE?
