OK i need help asap..... My friend has received an warrant of execution this morning the letter is dated 13th feb.... They are demanding £77.25 plus a balance outstanding of £121.08 they want this money by the 20th feb... The problem is the claimant is phoenix recoveries my friend has never heard of them or ever had any corrspondence off them she's never had any demanding letters or any debt collector letters. This warrant has just come out of the blue, does she have to pay this warrant tomorrow as she has no idea who they are thanks in advance

    tell your friend to contact your local courts. I'm not 100% sure but I have read somewhere that if you have had no communication at all about the court case it can be set aside and the whole process has to be re done which gives your friend the opportunity to appear in court and give their defence.

    Has the letter been read correctly? Does it actually say a CCJ has been granted by the courts or does it say we may apply for a CCJ etc? Allot of these letters are worded to panic the recipient into paying up as soon as they have the letter, note the word may not will. It seems a small amount for Phoenix Recovers to have obtained a CCJ on.

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

  • Hi she went to the courts today i had a good read thro the national debt helpline which was great thanks for that!! She took the warrant with her told them she had never heard or had any correspondence with phoenix recoveries then asked for the n244 form to have it set aside he then told her there was a fee of £75 but as i had read up i knew that she didnt have to pay this as she is in receipt of working tax cred.... Think she was pretty confident with all the info i got from here and the NDH, she has to fill another form in so she doesnt have to pay the £75 then take them back tomorrow before 4pm. She hasn't had a CCJ it looks like she might have owed someone money she's not sure who the only one she said she missed payments for were studio catalogue .... Dec and Jan payments but hasnt received anything off them either ... The court couldn't tell her who it was said she had to ring Northampton which is where the warrant has come from. All a bit confusing , she didnt hand any money over anyway.
