Hi this is my first post here and am after some advice
my DHs parents received a letter adressed to my husband (he hasnt lived there in 12 years) from a "private investgator" his parents opened the letter (another thread!) and phoned him, we live 200 miles from them and hes away with work (Army)
he rang the number on the letter and they said the company they represent is "global" and they "think" its regarding a old debt they are phoning hm back tommorow with more details of the alleged debt he has no memory of any debts and any loans we have had have been in both names and would come here to our home adresss (we are both on elecral roll) and we havent faulted on any,
so my question is what to do now? any one know who the company is?
i have told him not to give any details over the phone and not to acknowledge any debt
im just a big worrier like to have things in order and beng heavily pregnant with 2 children i dont like the idea of baliffs/ debt letters coming here for a debt we know nothing about
if you got this far thank you
Natalie

This debt is probalby statute barred, as consumer debts older than 6 years are unenforeaceble in the courts unless there is a CCJ and even them after 6 years, they need court permission to chase the debt.
Remember all the fuss about the bloke who never paid his mortgage and got the house nealry for free because the creditor failed to take action? Similiar rules.
This is assuming that this is not just a creditor fishing expedition where they have sent message to everyone with the same name.
So OH needs to refuse to answer any questions and needs only to demand that they tell him who they are looking for and with respect to what debt. if it is not his, tell them.
If it was his, tell them it is statue barred.
It is for them to prove to him that he owes the money and that the debt is enforceable, not the other way round. If you've have not made a mistake, you've made nothing0 -
RAS Thanks for that will pass on the message to my DH and see what they say tommorow you have out my mind at ease, will update tommorow when i know more
