P45 and pay question

My husband was in the army and in August 2007 went AWOL due to depression he handed himself back in March 2008 (between these periods he earnt nothing) he then got paid by the army until June 2008 and was then dismissed from the army. He started working for an agency in august and had to fill in a P46 as the army hadnt sent his P45 when he left the agency he was given a P45 but again too late to give to his new employer they just used his last tax code, his most recent job another agency didnt want a P45 or want hi to fill in a P46 as they said he is getting paid weekly and didnt need to...... surely this cant be right?

He is now about to start a permenant job and wants to get this sorted, its unlikely the agency he's working for now will be giving him a P45 AND even if they do it wont be correct as he gave them nothing when he started?!

Will he be owed quite a big rebate because of this and if so how does he go about getting this?

Sorry about the long post just really confused and not sure what he should do next x

    If you have provided P46's each time for a new job .. this starts at the basic rate of tax, so he would not have received his full tax free allowance.

    For each tax year you need to know the total pay and the tax paid.

    If you do not have a P45 when you start a job then you should be asked to fill in a P46. The P46 advises the tax office that you are working and they then get the pay and tax details from your last employer and pass them on to your new employer along with your tax code. It is these pay and tax details and your tax code that are on the P45. When your new employer has these details your tax will be adjusted so that you are then paying the correct tax. So if you have paid to much you will get a tax rebate or at least a reduction in your tax. It does sometimes happen that you have paid to little tax so an increase can occasionally occur. If you have worked somewhere that has not done a P46 then the tax office may have a gap in your records, if this happens they will contact you for a list of your jobs and will then contact the one who employed you during the gap for your details.
    You can always hand in a P45 late even after a P46 has been completed, the employer can still use it, and it may save waiting for the tax office to collect all your details.
    As far as the new job is concerned if he gets a P45 hand it in, it may be a proper code P45 or it may be an emergency tax P45. If it is the proper code with previous pay and tax then these details will be used, if it is an emergency code the tax office will find out the details and send them to his new employer. If no P45 then do a P46 which will be sent to the tax office and the correct code and pay and tax details will eventually be sent to his employer.
    Without knowing full pay and tax details from past employments it is impossible to say whether tax has been overpaid.
    If his details are not received by the end of the tax year then he will have to contact the tax office to get his tax checked.
