CL finance cca

Hi all,

My Dotty perkins store card debt was sold to CL finance after I was on a reduced payment arrangement for a couple of months. I sent a CCA request at the end of December and as yet have had one letter from them saying the were 'looking into the matter' but nothing else from them. I have had no statements-I have rung up to make payments- I paid all of the arrears off from when I was making reduced payments and am now back on my contractual payments which are showing on my credit file.
When I phoned they told me the statements have been stopped. So does this mean I don't have to pay!!!:rotfl:( I wish) What do you think I should do? I'm keen not to damage my credit rating anymore than it has been.

  • If you cca requested them, why were you still paying them? isn't a cca request to prove a debt enforceable or not?

    I just thought that they would come up with it- My luck. But they haven't???

    Sorry I'm just a bit clueless about what I'm supposed to do now.

  • I'm not sure myself, probably best to wait till RAS or 10past6 pop along to give some advice. They have much more of a clue than me. I think though the debt should be in dispute because they haven't provided a valid cca but I don't know where you'd stand because you have been making payments.

    12+2 working days after a CCA request is received by them, if the CCA is not provided or it does not have all the required prescribed terms then the debt is in dispute and unenforcable. At this point, payment need no longer be made.

    After this you send the 12+2 day letter stating that the debt is in dispute and that should they continue to pursue for payment without producing an enforcable CCA you will report them to the regulators. Then you should notify TS and OFT.
