Redetermition -scared stiff

Please can you give us advise. A CCJ was set at Northampton against my husband, we were paying 154 per month through cccs to tesco, they then involved incasso who then sent us court papers, A ccj was set at 354 a month.We wrote to the court and asked if it could be looked at again,also sent copies of our arangment with cccs together with expenditure details. Heard from the court who say the redetermination has been sent to the local court, they will be in contact when the case is heard. Does my husband have to attend or can it be dealt with out him there. This is ssoooooooo embarrassing. Thanks for reading this.

    Don't feel embarrassed - there is no need.
    A redetermination hearing is for the Court to consider changing the amount of the monthly payment.
    I would strongly recommend that your husband does attend to put forward how much he would like to pay each month and to explain why the sum proposed is the most that you can offer.
    If you do not attend then the Court can make a decision in your absence and could order a sum that you could not afford to pay.
    Attending Court is nothing to be worried about - and if it can result in you paying an affordable amount then it will help you.

  • Yep, I third this. Courts have even been known to arrange payments lower than the creditors' requests so it could work in your favour. Also, as you are with CCCS, the courts may see that the creditors are wasting the courts' time as you are taking steps to pay your debt back.

    I would also strongly suggest that your hubby attends.
