Where is this letter?

Hello

I have finally recieved a letter from a DCA regarding a catalogue account.

I was never told by the catalogue company they were sending this to the DCA, I went to log on to make the monthly payment and found out my account had been cancelled.

To-ing and fro-ing it seems that the amount I was paying was not enough for them and they sold it to a DCA - without telling me.

Anyway, have finally received letter from DCA.

Does anyone know where the template is to ask them to only contact me in writing (not phone) and for me to make payments I can afford each month?

    Just trawled through lots of pages and searched 'template letters' but can't seem to find?

    I know someone created a link with all the template letters.. could anyone point me here please?

  • Whilst I am doing that have you asked for a copy of your credit agreement. That's not because I am telling you to avoid debt BTW, it's because without that vital piece of paper a DCA CANNOT demand payment off you, it must be returned to the OC. Who would then sell it on, and go through it all again. But, without a CCA it's harder for them to enforce it without going to a judge to ask them to decide. No CCA = unenforceable. And if they do not have one, then that is a plus for you when you bargain with them for payments you can afford to make. A negotiating tool. I will be back.

    Edit, no I won't cos someone else got there. I can hazard a wild guess whom this catalogue is. And I can imagine there being a lot of late payment charges ... roughly £24 pcm added each time? What I am saying is, depending upon which way you wish to go with this, you can claim those back, use them to reduce the debt. I mention it because not many people know it can be done. And I can also guess at the DCA being an in house one. Which also means they aren't even a proper DCA. So, would this be NDR by any chance? If not, please do disregard. But Shop Direct is usually the main culprit. ;)

  • Here's one I made earlier, cos I did this for the nth time again today:

    With reference to the above agreement, I would be grateful if you would send me a copy of this credit agreement.

    I understand that under the Consumer Credit Act 1974 (Sections 77-79), I am entitled to receive a copy of my credit agreement on request. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    I understand a copy of my credit agreement should be supplied within 12 working days.

    I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    I look forward to hearing from you.

    The next part is really important. Just print, but don't sign your name on the bottom. That's because if no CCA exists ... well, they've been known to get on one if you know what I mean? ;) And use a Postal Order for the £1. Again, for the same reasons as if you pay via cheque they'll have a sample signature but also access to your bank account sort code and number. Which you don't really want them to have. ;) Now some do put in the letters that the £1 isn't to be used for any other purpose than your request. Mention that because they can often use it to pay off your debt instead. They can read but they still do it.

    Then see what they come up with.

  • I missed a bit. Send first class recorded delivery then wait out the period in the letter. They can still produce one even after 12 days ... even after a year in some cases. They have to route around in their filing system, microfiches and so on. Or moves from one desk to the next one. But, whilst you are waiting for it it gives you breathing space to decide what to do next.

    You are at the stage I was this time last year with all my creditors.

    Now, as a forewarning to the recorded delivery thing. You may find you can't get confirmation online. Don't worry if not, because if it's to a PO box they are signed in batches before delivery. There is a department within Royal Mail that can either fax/post or email in my case within minutes the batch signatures. But don't worry if you don't get it at first. Because you can also trace whether your PO has been cashed. I have unfortunately lost the number to ring, a special number not advertised well, that is separate from their customer services. They can tell you straight away if your PO has been cashed. So, even if the creditor/DCA says they haven't received your letter. If they've cashed it etc.
