If she called before 27th October, then this may have been the case as benefit claimants were always obliged to claim but if it was since then there is absolutely no reason at all why the CSA would not close the case for future maintenance and just collect the arrears. Has your hubby asked the CSA if the PWC has requested closure as she has suggested to him?

Not yet, hasn't had time. I think I will get him to do so though because they should give him that information. I personally don't think she's asked for closure at all, just reassessment as she threatened to do last year, and I think his mother is sticking up for her!!

Just a thought, what would they do if he phoned his ex and asked her to ask them to close the case (again) and she did so? Would they still require the information they have asked for? Also, could he write to them saying that he was under the impression from his ex that she was going to ask for closure and query what's going on? If she did indeed ask for closure now, would they still pursue his information?

If she asked for the case to be closed I would think they would just close it rather than do new assessment then close it!
  • i think if she even uttered the word closure they would close it straight away, there arn't going to put in all the effort of carrying out a new assessment when they could just close it down there and then.

she may be confused if they have told her they cant technically close the case if there is still some money outstanding but if that is the case there would still be no need to carry out the re-assessment
  • My ex closed the case once and it was done instantly.

Get Hubby to call CSA and ask if she requested reassessment or closure they should tell him the truth.

I've caught my other ex out by telling me lies and when I've asked the CSA they tell me different.

Shes lying. And so is MIL.

There's no money outstanding to her. My husband has been paying via the CSA via Direct Debit on his last assessed amount for the past 4 years.

He is going to talk to her about it and try to persuade her that it's in no-one's interests to have him reassessed, and that as long as she gets her £20 a week she should be happy and content with that. She may of course want him to have to pay the government, just to spite him, which wouldn't surprise him, but we have a bit of an ace up our sleeves in that we made payments direct to her on top of the CSA DD which we know she didn't declare to the Benefits Agency. She was done for benefit fraud a few years ago, so I'm sure they would be VERY interested in knowing she's received undeclared money, especially as this would be the second time!!
