Does anyone have any idea how i get this company off my back, about 2 years ago i ordered a mobile phone with 3G, when the phone never turned up i called them and told them to cancel the contract, they said they would but then i received a bill, i called and they said that this would not happen again, it did twice. I then called again and they said i would not receive anymore bills and the account would be closed and no money would need to be paid. I asked for a letter to confirm this several times but nothing every arrived. Fast foward 18months and i have been receiving letters from SRJ saying i owe £85.01 i have tried to call 3 to sort and each time they state the account is closed and they will inform SRJ, today i have received a letter from SRJ saying if i dont pay within 7 days they will be taking me to court, i have called them again and they say i must pay, i just dont see an end to this, i have even forwarded a copy of my credit report showing this was settled in July 07! What else can i do?

Hi Rosie,
If you’re confident that the debt isn't outstanding, I would be inclined to write a letter to them sent via recorded delivery explaining that you do not admit to any claim they make regarding the £85.01. The Debt Collection guidelines written by the OFT state that it is a unfair business practice to chase someone for a debt that is settled.
Part 2.6 (H) of the guidelines states the following is an unfair business practice:
"ignoring and
/or disregarding claims that debts have been settled or are
disputed and continuing to make unjustified demands for payment"
If they creditor ignores your claim, you can then escalate it to the OFT directly. Should they attempt to obtain a CCJ against you, you could defend the claim on the basis that you feel the debt does not remain outstanding.

there are at least 6 other posters who have recently raised the same issue with the same debt collector, I think all re phone accounts.
You maigh want to pm them and see if you can have a concerted effort reporting them.If you've have not made a mistake, you've made nothing0
