Well indeed, my friend who allegedly received the mailshot genuinely does not have any recollection of this. They're FTB's so the EA's will be sending out house details like crazy, how on earth are you supposed to recall them all. I have mentioned this in my letter to them that although they may be able to prove they sent the mailshot how can they prove the recipient read it? They can't. Greedy....plus they've offered me a discount of 25% - as I said to my partner that in itself is acknowledgement they don't have a case, surely any EA truly believing they have a case would stand strong at their fee and not back down. I think they're trying it on.0

Upon re-reading the EA's complaints procedure it notes that if I am not happy with their detailed reply to my complaint then I can contact them again (how very kind of them...) so they can review their decision. So....I've decided I will give them this chance to rectify their mistake shall we say but note at the bottom of my letter that as per their complaints procedure if I am still not happy with the outcome then I will register a full complaint to the OEA. Can't say fairer than that can you?0

Today I've recieved another letter in reponse to mine saying that the woman I'm dealing with there is on holiday as of today until 2nd March and wants to know if I could wait for a full reply until then as she wants to deal with it personally. She's also said if that isn't acceptable to contact their solicitor quoting a reference. She hopes this is acceptable and that she will revert back to me upon her return.
What do you make of that? Not sure if the solicitor bit is meant to scare me or that it's just routine now I have complained for them to file something with their solicitors?0
