  • im gonna take your advise and step back as its giving me a headache!! im gonna send the N9B tomorrow by recorded delivery and lets see what happens ( you never know your luck they may backtrack!!) - ii presume i leave the counter claim bit blank??

  • i just done the acknowledgment thing on line so at least they have a reponse and its will give me a day or 2 to get over this headache!! - ill give it a couple of days and then submit the defence on line as you discribed earlier in the thread later in the week

  • morning all - well i completed the acknowledgment on line on Monday to make it 28 days - shall i send the completed N9B now or give a week or so

    (also sent a cca request and a CPR 18 - request for information just for good measure)

    Hi Louie, hope you're ok, l think you may need 10past6 or Ras for this one, lm not quite sure, obviously if you've done your acknowledgement l think you have 28 days now, so its up to you, but best wait for someone else to tell you whats best.lmust admit on myOH's l didnt know wheter to wait the 28 days or to get it done and out of the way.
    lknow when we took ge money through mcol they left theirs till the last minute.

    Hi Louie

    I've just noticed your thread thanks to nova for bumping it.

    There is no need to hold onto the N9B form, you can submit as and when you're ready.

    Couple of points, at this stage you don't have to give a full defence, just a short sentence as to what your defence will be based on.

    The true defence you'll be relying on in court, will need to be submitted 7 days before your hearing.

    Louie, for your own good, make sure you understand a) what you've requested from the claimants and b) that you FULLY understand it, don't just copy & paste, it will show at your hearing otherwise ;)

    and thanks 10past6 for the reply - dont know what id do without your and the others expertise - i konw us newbies must be very trying at times - always trying to run before we can walk - i remember the old saying 'slowly slowly catchy monkey' think ill try and remember it more often

    anyway in my defnse box on the 9NB i was going to put exactly what you said to put word for word

    I dispute the claim based on the claimant not complying with the correct legislation within the default notice, and therefore unlawfully terminating the agreement.

    i know where yourcoming from with being carfull what you ask for and i will - the requests have gone now so i cant get em back - guess i should play my cards close to my chest

    Hello! yes it'll be good to help others out but l dont know if l'll ever be that good! The experts on here are fab, l've saidthat many a time and will go on saying it. lm just so grateful that they take the time to help people like us out! l really dont know what state l'd be in if l didnt have them.
    You and me between us are like a full time job!!!! l have visions of them shaking their heads when they see either you or me posting!!!!

  • i have completed the acknowledgment on line Monday saying i was going to fight it but am now having second thoughts - if i now decide to admit the claim does it revert to the 14 days and therefore i only have a week to get the admission form to payplan and then to submit my offer
