CCA Request

Good morning
Since October 2008 i have been chasing a cca request with a dca.Basically i took a loan out a few years ago but after losing my job i got into a bit of money trouble.Anyway this was back in 1998 and since then have been paying a very small amount to them each month. Now back in October i asked for a copy of the cca which it took me ages to explain to them what the document was etc.In Jan 2009 i sent them a letter which i used one of the cca requests templates.I have now had a letter from them which arrived to day but cannot produce the cca
"We have contacted the abbey national in regard to your request for a credit agreement but they have advised that due to the age of the account they no longer hold the the original documentation,as such they cannot provide you with a copy"
it goes onto say
"The monthy payments you have made on this account since 1998 until september 2008 classifies as admission of liability"
So any ideas on next move people.I have never missed a payment on this account .

Well that's such a shame, until they DO provide the correct paperwork, your account remains in dispute, and as such, you're under NO legal obligation to pay them.
"We have contacted the abbey national in regard to your request for a credit agreement but they have advised that due to the age of the account they no longer hold the the original documentation,as such they cannot provide you with a copy""
Claptrap, let them tell that the judge, should they be foolish enough to commence legal proceedings."it goes onto say
The monthy payments you have made on this account since 1998 until september 2008 classifies as admission of liability"Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
"The monthy payments you have made on this account since 1998 until september 2008 classifies as admission of liability".
Since you are not disputing liability, that is irrelevant.
What they have admitted to you is that the debt is unenforceable.
You are not obliged to pay any more money to them.If you've have not made a mistake, you've made nothing0 -
