can they give me a default by phone??????

Hi all,
I have received a default in 2007 from British Gas and only just found out.
I started the process of trying to have it removed by writing to them asking them to provide me with a copy of this default as to my recollection I have never received one.
I have received a letter from them which states that when I made a telephone call to them to arrange a payment scheme they warned me that i could get a default. Can they give me default notice by telephone? I do not remember this.
I have never missed the payment arrangements but I started it late.
Can anyone advise me of this as I need to apply for a mortgage soon?
Any help would be most appreciated.

Just repeat the request for a copy of the credit agreement, and a notice to default, its taken me 2 months to have a default removed from my credit report, although it was unjust really. I take it your using templates from another site.0

Thanks Matty, I will continue with the templates I am using. It would seem that it is unlikely they will have it in writing as they have admitted that they just told me over the phone. I was just wondering can they do this.
Also as well as it is British Gas they reckon they are not covered under the Consumer Credit Regs.

Utilities are not covered by the consumer credit act.If you've have not made a mistake, you've made nothing0

It was a utilities company also, they may not be covered by the consumer credit act but surly they have to put in writing that failure to pay will incur a default and will affect your credit worthiness.unless of course they have a recording of the call. I guess you could always request a copy of this, if they have it. If not it may strengthen your position.0

Does anyone know what the utilities company come under if not the cca. I dont know where to look to see what my rights are.0

I just would like someone to point me in the right direction of who covers the Utilities Company. Obviously I didnt sign a credit agreement and when I read all the stuff on removing a default it seems to point to the Credit Consumer Act.
I just cant get my head around the fact that they have written to tell me that they wared me by telephone!0 -

Will write the letter today and let you know how I get on.
Would like to be able to read up on the law governing the utilities to bumph up the letter and generally know when a default is legal or not. I just cant find who governs them.
Thought if my letter had some points of law it would make it a bit more punchy!:D0 -
may not hold much weight but try mentioning being in contact with citizens advice.0
