DLC Direct Legal Collections- Car Loan

Hi Everyone i'm new to this site so therefore apologies if my message has not been received properly.
To cut a long story short I bought my golf in 2004 on hp from VW however i fell into financial difficulty and was unable to make the final payment, the loan was referred to a company called DLC.
DLC have been in my opinion agressive, underhand and unprofessional in their dealings with me. I have had unauthorised money taken from my card, threats from a bogus solicitor working on DLC's behalf. I have an existing arrangement with DLC where i make monthly payments of £250.00, however i have missed one payment which i confirmed would be paid at the end of the month Feb 28th when i am paid.
The operative responded by saying she was not prepared to wait until then and would issue recovery for the vehicle.
Can anyone help me with some advice please, i have three children and desperately need my vehicle, the balance on the vehicle is £1,500.00.

First of all ,, write to DLC requesting a copy of the executed agreement under scetion 77 of the Consumer Credit Act 1974. You must include a £1 with your request. If you pm me with your email address i will provide you with a template letter to do this.
If the debt collection company does no provide you with a copy of the agreement within 12 days the loan is unenforceable until they do. You may get lucky and the lender has lost it or destroyed it. DLC will definitely not possess it just now that is for certain. They cannot enforce or repossess until such time as this has been supplied. That will give you breathing space.
secondly, how did you get the loan? Did a forecourt arrange the finance? If so there is another hammer to hit them with.
Finally did you take out ppi , gap insurance or breakdown cover with the loan?I am a former Broker, former IFA and former compliance officer, for my sins.

Hi Peter MB thanks for coming back to me I bought the vehicle brand new from a volkswagon dealership in Mitcham they arranged everything, i think i did take out gap insurance and breakdown cover at the time, i will look through the original paperwork and confirm details of the HP agreement shortly.
