CCa request to capital one. They sold the debt!

Ok so I had a credit card with capital one long story but they were harassing me a lot (6 calls every day). So I requested a copy of my CCA in the end of December, they received the letter 30th December, Mid January I started to get phone calls from Debitas legal services, lots of phone calls. I tell them over the phone that the debt is in dispute and I write to them to inform them. This still doesn't stop them from phoning me. The other day I had enough, I asked to speak to the manager once again I told them the debt was in dispute and they should give it back to capital one, the manager basically said they wouldn't do that and to pay up or else. So I asked when the debt had been passed on to them, she said 10th January I asked if I could have the names or employee reference numbers of everyone I had spoken to, so I could include these in my complaint to the financial ombudsman. She said that whilst they note the account every time they don't have anything on the notes to identify which employee wrote the history (which I find very hard to believe having worked in many call centres myself). So I filled in a complaints form for the financial ombudsman's service and posted it off yesturday. If anything what will the financial ombudsman service do? And how long until I can expect to hear from them?

If you hear back from them within 6 weeks then you've done well, when I went to them over a PPI I didn't hear back from them for over 3 months.0

Debitas are Capital Ones in house debt collection department so in that sense they have not sold your debt, merely passed it to another department in Capital One. As I understand it, you need to exhaust Capital Ones own complain procedure first before you can take it to the ombudsman. Be sure to note the times of all the calls and have copies of all correspondence to be able to show the ombudsman if it gets that far. Try to keep things in writing as telephone conversations are not so easy to prove / document0

Just to confirm waht Norfolk Jim said - Debitas are part of Capital One - so regardless of wether they are chasing the debt- the Clock is ticking in respect to the CCA request.
When Debitas call - just say to them - that there is a CCA request that has been submitted to Cap One and as you are part of them - you should not be calling me whilst there is a CCA request in place end of.I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0 -
Just refuse to answer ANY security questions when they call . Apparantly you have to exhaust the companies own complaints proceedure before contacting FOS. I would not bother . I just keep replying SEND ME A TRUE SIGNED CCA .0
