Online retailor asking for goods back?

I recently purchased some goods from a retailor, paid for them and goods were despatched/received. The retailor has now noticed it has made a mistake (one week after ordering), and appears to be wanting the goods back. I just received the following email:
Dear Mr xxxxxx

We are sorry to hear you have received the items you have been refunded for. Please call 08444 xx xx xx at your earliest convenience and ask for Nicola.

I can then arrange a collection of these items.

I have made no contact with this retailor whatsoever other than the purchase, so there is no way they can claim that I have asked to cancel. So, from a legal standpoint, what can they do? If Tesco emailed asking for some beans back I know what I'd tell them!

    You're saying that you have not cancelled the order but they have made a refund by mistake. Well, if you want the goods, just tell them so and authorise payment unless you want to be DISHONEST!

    altho I'm no legal expert, I would have thought that since you paid for the goods, and they sent them, that you had a contract at that point.

    Obviously you ought to pay for them, but I suspect thay they don't have a leg to stand on.

    Any idea WHY they want the goods back?

    Yup, they were under priced. I'm guessing they realised their mistake, and as money has changed hands and goods have been delivered, realised they couldn't now cancel the order. I presume this is to see if I will return them, as I guess some people will, but I'm unsure if I want to TBH.

    I was under the impression that once a sale got this far, it was a done deal? Also I can see no refund in my account for the amount I did pay. Can they ask for the difference?

    I suspect someone has clicked on your email address by mistake in their mail clients address book, possibly there is another customer with a similar name, give them a ring.

    All you can do is to phone them and ask what is going on. I think that they are within their rights to claim an item sent by mistake as long as they arrange for a courier to collect the items, but if it is a simple case of them having refunded you by mistake you need to explain that you do want the items and ask them to bill you again, but make sure that the refund has in fact gone into your account in the first place.

    what was it they want back? Wine......drink it, food.........eat it. Then tough!! If it's a Fridge Freezer or the like............????????!!!!!

    No idea, and not even sure I have been. It seems to be a poor attempt to get me to return mispriced goods, after the transaction has finished. I have just been told that there is a legal route for them to recover it, something to do with fair expectation of sale prices, but not sure on the full truth in that.

    tell them you've sold the goods on. They can't do anything about that can they?

    The e-mail seems to be implying that you have received items which you had cancelled and were refunded but they were sent out by mistake? Well that's how it reads to me, is that what happened? In that case you should have refused delivery. If you bought items mis-priced then that is a different matter, I think if you have the price in writing (that you actually paid) prior to receiving them, then there is not much they can do. If you have an account with them or are registered on their web-site you can easily check transactions by logging in surely? :confused:
