The original quote from the e-mail that the OP posted up sounds like it is specifically intended for people who had previously been customers, there is absolutely no way they can deny that! Why would they send that voucher with THAT wording if it was for new customers? The mind boggles!0

This happend to me also last year. I complained to Lovefilm who were not helpful at all.
As its a giftcard that has been sent you by them and you have reactivated using the giftcard (in section for current members to reactivate), your online account states that you will not be billed until the free trial ends, then they really havn't got a leg to stand on, no matter what the ts and cs state. I would keep phoneing them and complain, like crazy, each time refuse to speak to the operator and ask for a supervisor or manager, get all names spoken to. If this doesn't work, then write them a stern letter, stating all the facts and figures including bank charges, complaining and threaten them that if they do not resolve accordingly within 14 days that you will take the matter up with the small claims court. If they do not give you the refund, then its upto you if you wish to persue.
I would also in the 1st instance speak with your bank and ask them to reverse the direct debit payments under the direct debit garantee (this is what worked for me!) as they have been taken wrongly by the company. Advise them also you have proof stating that when the 1st payment will come out and you can send if need be, also tell the bank that the company involved do not want to know and are not being helpful at all. Also confirm the direct debot is cancelled!

I always warn people away from having anything to do with Lovefilm, as no free trial or free gift is worth the crap service (not to mention it's just stupid that you can't rank movie selections by number). Lovefilm seems to have the worst customer service and to actually have policies aimed at ripping customers off (like if you quit they may claim they didn't get your final dvds back, so will keep charging you a monthly subscription until they receive them. And you can't send it back because you already did. And you can't report that it never arrived online, you have to call CS and ask them to send you a form in the mail, which may never arrive and you can't report it lost in the mail without the form. Some people just end up paying for the disk and the extra month or so of service to get Lovefilm off their backs).
Anyhow, there is a site where people talk about Lovefilm, and apparently a Lovefilm employee is (or was) trying to help some of those with complaints. Might be worth a look:

T&C's are there for a reason, don't come whinging here because you didn't bother to read them.
Another arrogant unecessary post from you, abusive at that.
Now, if YOU bothered to read the original post, you would see that the wording on the card says come and see they are even better for free.
So you stop whinging at a poster who has a legitimate complaint.
Thet cant say come and try us again for free then say, hold on you cant as you have had a free trial.0 -
its debit card payments not direct debits so cant use the direct debit guarantee.
Also I had a similar problem with someone else last year and Halifax told me that by giving a company / person your card details you are authorising them to take payments to any amount and theres nothing you can doWins so far this year: Mum to be bath set, follow me Domino Dog, Vital baby feeding set, Spiderman goody bag, free pack of Kiplings cakes, £15 love to shop voucher, HTC Desire, Olive oil cooking spray, Original Source Strawberry Shower Gel, Garnier skin care hamper, Marc Jacobs fragrance.0 -

Hi all, sorry its taken me all day to get back on and update.
I had a call back from the manager, head office have apparently decided as a 'goodwill' gesture to refund half of the money. They are adament that this is goodwill only, and does not imply any liability and that I am still in the wrong.
They have given me a freepost address to write to if I want the other half of the money back, which I will be doing, and a strongly worded letter it will be too!!
Oh.. and I shall also be sending them back the remaining 'gift' card.. they can stick it up their..:whistle:
