I would seriously think about paying under protest - that is if you could stomach actually dealing with the place - and take it up with them when you get back from honeymoon.
Are you sure you would be able to find somewhere else? Of course, it was more expensive, you would be entitled to claim the extra cost from the original venue.
Oh, and definitely entitled to claim for inconvenience, stress and "loss of enjoyment".0 -

I have found somewhere else which is a LOT cheaper than the original venue anyway. PLus they are throwing in extras such as fresh flowers and not charging corkage whereas original venue were charging £9 per bottle!
Had not given much thought to claiming for stress, inconvenience etc but
after hearing everyone's advice on here will definitely give it a go.

To be honest, legally, if it is cheaper, then you haven't suffered any direct loss.

Yes we're happy with the new venue. In fact we wanted to book it initially but it was out of our price range. Can only afford it now as it's a late minute deal.
It is true that the alternative venue is cheaper but the current venue are trying to pursue us for an additional 30% of the total cost of the venue including food etc which is the main reason I wanted advice. This could potentially cost us in the region of £1500 which we thought we would have to have paid plus the cost of he new venue we would still have been worse off.
Happily I think we now have a case to avoid paying the 30% plus get our deposit cheque back as they have breached the contract. Apparantly this means that the contract is classed as never been made and we are therefore entitled to our deposit back.
We have drafted the cancellation tonight and sending by Recorded Delivery tomorrow so will see what happens!0 -
Oh - when sending the cancellation ENSURE that you are saying that it is because you feel they have reneged on the deal and therefore you consider that they are not fulfilling their contractual responsibilities.
In other words, you are terminating the contract for default and not, for example, because you have changed your minds.
I just don't want to see you hit with a cancellation fee....0 -

Yes I've said that we are cancelling as we believe that they are in breach of contract.
Consumer Direct said that the contract was made when we returned the booking form and deposit. Once that was done they can only put the prices up with our prior agreement so they are in breach.

Another thing to consider is if the Hotel are in financial trouble. Lots are going bust, a friend of mine booked a party of 8 into a local hotel for New Year,Dinner and overnight stay £230 pp. They got a letter the week before to say the hotel could not honour their booking,so they asked for a refund,which was given....but the cheque bounced,and, as they paid by cheque they are now waiting in the creditor queue through the administrators.
So,I hope you get your deposit back,but they may be in trouble. Always better to pay by CC or even debit card and then you can claim from the CCcompany or do a visa chargeback.

I have taken out wedding insurance so hope this eventuality would be covered by that.
Neither me or partner have credit cards so had to pay by cheque. The venue has no facility to take card payments anyway. It is in the terms and conditions that the deposit and all other monies are paid by cheque!!0 -

Have a look to see if your wedding insurance covers legal costs against non-performing suppliers.0
