default been issued on a disputed account

Hi there,

I will start at the begining I recieved a letter from a dca called iQor just before christmas regarding a credit card debt they starting ringing me day and night around 15 times a day so I starting reading post on here and sent off a CCA request, I recieved a letter back from the last we saying they dont have it and at the moment Halifax have not produced it and that they do not alter any of my data, it as been 40 days now since they recieved my request.

So all month I have been looking at my credit file and today I get and email from experian telling me of a change so I go on and find that they have issued a default on me and it says the account defaulted on the 16/12/08 well like I said I have been checking my file all month and this as not been there until today and I have had no paperwork to say this was happening.

My question is can they do this when my account is in dispute and of course in default on there end?, and also I have had no paperwork to tell me that this was going to happen?

If they can not do this what do I do now??

Please if anyone can give me some advice it would be appreciated because I am quite worried and upset by what is happening.

  • The Halifax did similar with me when I was taking them to court over bank charges. In the end, I had to write to the Chief Exec's Office to have the matter resovled as it was, quite frankly, taking too long with their Customer Services team who didn't even seem to think that there was a problem!

    Obviously to do so is contrary to the Office of Fair Trading's Debt Collection Guidance Note from 2003 which makes it clear as to what can and can't be done when an account is in dispute.
    Almost debt-free, but certainly even with the Banks!
