Dear all, A little bit upset by Freedom Finance for a number of reasons and need some advice.
It relatesprimarily to PPI sold up front, completely useless, no options etc etc so followed stafe 1 of Martins letters to reclaim. The response came today.

Despite taking the loanvia Freedom Finance they claim that they only 'processed' the loan on behalf of someone I have never heard of: [TEXT DELETED BY FORUM TEAM] Bespoke Finance Ltd, (formerly Karacus!!) Suite2C, Eurolife Building, 1 Corral Road, Gibraltar. [TEXT DELETED BY FORUM TEAM]
I have never heard of Bespoke Finance Ltd, [TEXT DELETED BY FORUM TEAM] or Karacus and would most certainly not have taken any loan from a company operating outside the UK.

So, my questions for advice, are Freedom Finance spinning me a yarn and are they legally liable? I believe they are, I took the loan through them in direct response to their advertising in the UK and being registered in the UK.I hope theOmbudsman will consider this reasonable and confierm they are indeed liable. 2) [TEXT DELETED BY FORUM TEAM] does UK Law in respect of Fiancial Regualtion cover Gibraltar as a British outpost? I am extremely concerned that if not and Freedom Finance are not liable I am at a loss of around £7000 consequently, despite buying a loan in good fasith froma UK company registered by the FSA.

Does anyone know? My understanding of UK contract law firmly places responsibility with Freedom Finance (who may well still be using Overseas brokers so be careful) but I would appreciate second opinions. Also I am really angry that they have passed on my details without permission to some dodgy third party who will no doubt claim to be straighter than a dye but saw fit to change company names and take flight to southern Spain.:eek: ......it doe4sn't exactly inspire confidence. I've also heard that Co-op are pushing customers with sizeable overdrafts down the Freedom Finance route which is highly unethical given there stance on moral high ground banking, but that is also a seperate issue. Avoid Freedom Finance like the plague unless you want an experience like mine.

    Freedom have registered offices in Sweden, Ireland and Spain.
    Bespoke Finance is possibly a trading style of Freedom, they are mentioned on the website, don't be too alarmed.

    Chase them via thir Wilmslow address.

    If you need to know who the lender is find a copy of the credit agreement or simply check the DD payment.
    Freeedom brokered the deal and made plenty of cash, it's they that deal with the redress.

    We had a letter on the 9 February 2009 from GE Money to say our PPI insurance ran out on the 10 March 2009. We had no knowledge of any PPI on this loan which we took out with Freedom Finance in March 2004 and infact cleared off in November 2004. We therefore sent the PPI refund letter to GE Money as per website, and got a reply to contact Freedom Finance direct (the amount of the PPI is £2250) - Freedom Finance got back to us in less than 24 hours and stated [TEXT DELETED BY FORUM TEAM] Bespoke finance in Gibralter.

    I duly rang Freedom Finance and they more or less stated that I would get no luck [TEXT DELETED BY FORUM TEAM] and to take legal advice.

    We have contacted the Finance and Leasing Association for their advice now.

    [TEXT DELETED BY FORUM TEAM] I'm keen to learn how you got on with the Finance & Leasing Association. I smell a rat, I've spoken with a mate who is in Banking and reckons as they'r ein Gibraltar, basically we're without paddle in creek.

    However, I certainly feel that Freedom Finance are also responsible, I'm owed about £6.5k.......and will chase FF.

    All this is of course nonesense.
    The rightful recipient of your claim should be the lender not the broker.
    You can make a successful ppi claim against the lender if the loan is current or
    previously redeemed, Whether the insurance has been claimed on or not and even if you have already been offered your premiums back or the cover has now been cancelled.

    There are still issues that will allow you to make a claim.......And you can claim this off the lender. Dont let them fool you, dont let them fob you off or put up smoke screens, which they attempt do all the time.

  • have received a letter from Bespoke finance in gibralter to they say that we do not have a claim as we signed the agreement which clearly states the outlines of the ppi however we were not advised of this by ff they did everything through the post to us and basically told us to sign where the cross's were on the forms... GE money keep fobbing us off saying that they are not the people we should be going for... we didn't even get any details of the ppi agreement they have quoted in there letter :at the time of conducting business with you freedom finance (acting for Bespoke finance ) was not required to be authorised and regulated by the financial services authority ..... have you any suggestions as we dont know what to do next?????????????

    I have just received the same reply but the letter does state that Freedom Finance were acting on Bespoke's behalf, I have spoken with the FOS and they have asked for the letter and that which I originally sent to FF, they intend pursuing FF on my behalf, any info would be gratefully received by PM!

    this is the letter we have received as well.
    i am starting to think they are taking the michael. any help would be gratefully received.
