The Guardian Makeover Competition (the "Competition") opens on Monday 19 January 2009 and closes at 23:59 on Saturday 18 April 2009 (the "Competition Period"). No purchase necessary to enter or win. Void where prohibited by law. Entries received after the closing date will not be processed.
Entry into the Competition is acceptance of these Terms and Conditions.
(1) Eligibility. Competition is open to (1) legal residents of the UK aged 18 years and over who own their own business as a sole proprietor, any UK partnership or UK-based corporation (2) that is operating in the UK, and (3) whose employees number 250 or less ("Participants"). Competition is not open to: (1) employees or agents of Cisco Systems Ltd. or Cisco Systems International B.V. (collectively "Cisco") or Guardian News & Media Limited ("GNM"); (2) employees or agencies of their respective affiliated companies; (3) the immediate family members or members of the same household of any such employee or agent; (4) anyone professionally involved in the administration of this Competition; (5) Cisco resellers; or (6) competitors of Cisco or GNM (as defined by GNM and Cisco in their sole and absolute discretion).
(2) How to Enter. To enter the Competition, fill in the boxes on this page as requested and click the 'Submit' button. Limit one (1) entry per Participant. Entries on behalf of another person will not be accepted and joint submissions are not allowed. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
(3) Winner Selection. The winner will be chosen from a random draw of eligible entries. The judge's decision will be final and no correspondence will be entered into.
(4) Prize. Winner will receive a communications system and related consultation and installation services as described below (the "Prize"). Approximate retail value of the Prize is ₤5450.
System. The winner will receive a high quality business communications system, including the following equipment: two PVC2300-EU IP CCTV cameras, five SPA962-EU full featured colour screen IP phones, one SPA9000-UK IP PBX, two WAP4400N-UK POE wireless access points, one SRW248G4P-EU 48 port smart switch, one NSS 6100-EU NAS (including 1tb), one RV082-UK dual WAN router and one SPA400-EU voicemail server (collectively the "System"). System is provided pursuant to Cisco's standard terms, which may be located at cisco.com/legal/index.html and clicking on "EMEA."
Consultation. In addition the winner will receive a one (1) hour consultation with a Cisco engineer to take place via the WebEx teleconference system. This consultation will take place at a time convenient to the winner and Cisco. Based on the consultation, Cisco will configure the system equipment to address winner's business needs.
Installation. Cisco will work with winner to make arrangements for equipment installation through a Cisco certified installer ("Installer"). Installation will take place at a time mutually convenient for the winner and Installer, and shall take place under Installers terms of installation. Winner is solely responsible for making sure existing network infrastructure is sufficient to support the System. Neither Cisco nor Installer will perform any network infrastructure or network cable installation, server work or any other work not included in or directly related to the Prize. Prize does not include ongoing support for the System past installation.
The Prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes. GNM and Cisco ("Competition Entities") accept no responsibility for any costs associated with the Prize and not specifically included in the Prize, including, without limitation expenses, insurance, maintenance, repairs and any warranties. Winner is responsible for the payment of any and all taxes, duty, national insurance and/or licenses and or other fees that may apply to such prizes or winnings.
GNM retains the right to substitute the Prize with another Prize of similar value in the event the original Prize offered is not available due to circumstances beyond its reasonable control.
(5) Winner notification. The winner will be notified by GNM on or about Tuesday 28 April 2009 and given details regarding delivery of the Prize and Cisco's details to arrange the consultation referred to in paragraph 4. The Prize will be provided directly to the winner by Cisco or agents of Cisco responsible for delivery and installation of the Prize.

(6) Winner's List. Details of the winner can be obtained by sending a self-addressed, stamped addressed envelope to the following address: The Guardian Marketing Department, Kings Place, 90 York Way, London N1 9AG, UK.
(7) Promotional Activity and Release. The winner may be required for promotional activity. Participants grant GNM and its agents and assignees, full permission and authority to use, publish, and display participant's name, voice, and photograph or other likeness for advertising or other related purposes in any media without additional compensation unless prohibited by law. Winner may also be sent an affidavit of eligibility / liability / publicity release ("Release"), as well as additional documentation as may be required to facilitate System delivery and installation ("Documentation"). Unless restricted by law, winner will be required to complete and return the Release and other Documentation within the time period specified therein. The Prize may be forfeited and, in such case, an alternate winner may be randomly selected from among the remaining eligible entries if a winner: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and Documentation and to return the documents in a timely manner as required pursuant to these Terms and Conditions; or (iii) cannot accept or receive the Prize for any reason.
(8) General. To the extent allowed by applicable law, Installer and Competition Entities shall not be liable, and accept no responsibility, for (i) any delay, loss, damage, liabilities, distress, disappointment, or inconvenience for or arising from the Competition, including any delay, loss, damage, distress or inconvenience related to any prizes howsoever arising; (ii) any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Competition; or (iii) any costs or expenses associated with any prize which are not expressly stated to be included in the prize, including, without limitation, meals, medical, living expenses, gratuities, service charges, optional excursions, phone calls, gift shop purchases taxes, insurance and transfers. Nothing in these terms excludes liability for death or personal injury caused by Installer's or Competition Entities' negligence or for any other liability that cannot be excluded by law.
GNM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside its control.
The Competition will be governed by the laws of England and Wales, and the English courts.
(9) Privacy. Except to the extent that you have agreed otherwise, personal data provided by you as part of this promotion will only be used for the purposes of administering this promotion and will be processed in accordance with GNM's Privacy Statement which can be located at: http://users.guardian.co.uk/help/article/0,,933905,00.html.
