offering f+f settlement when creditor submitted claim form for ccj??

hiya, just a quick question.

i owe lloyds tsb 2735 which i stupidly ignored and now i've got a claim form from northampton county court.

a very kind relative has offered me the money to clear this and pay them back instead, can i offer them a lesser amount for full and final settlement or do i have to pay the whole amount now it's gone this far????

    Even if a CCJ is awarded, you can offer a lesser amount.

    Don't forget to claim back any missold PPI and charges.

    Becky, you are probably better putting this in writing.

    Are you currently meeting thepayments that the court had set? How long would it take to clear the debt at that rate? - this may influence whether they agree or not to a reduction and how much they will accept.

    Don't forget that you need to get it in writing before sending any money and that a partial settlement is of no use to you.

    Have you put in a defence for the CCJ? was the debt for a creditcard or loan? Have you requested a copy of the CCA? Was this signed before 6th April 2007?

  • ccj not been passed yet, just got claim form yesterday, will phone them and see what they will accept and get them to confirm this in writing first!

    If you are not near northampton, you should ask for a change of venue to a court that is closer to you. Not sure how long you have to fill in the defence, but if they don't have an enforcable CCA and the agreement was from before April 2007, this should be your defence.

    Worth spending the £1 for a copy of the CCA incase they don't accept your offer and try to go to court.
