    Hi,

Bailiffs collecting for magistrates court fines ( including no tv licence) can force entry on a first visit, although this is very rare.

Can someone tell me if a court appointed DCA / bailiff has more rights to enter property, threaten ect than a normal DCA/bailiff?. Someone has asked me this as they have been told they can enter(break in:mad: ) their property without them being there and that they have more rights than "normal" DCA/bailiffs.

    Many thanks folks. Dxx

Are we having a gossip, or do you have a specific issue with bailiffs?

The answer to the question above is: Depends which bailiffs and which warrant.
If you have a specific issue: Tell us which bailiffs and which warrant (see above) and we can break down the details.

Assuming you mean "Debt Collection Agency" by "DCA" then this is where it gets interesting. A debt collector has about as much right and power to enter your property and take stuff as your paperboy or milkman.

A bailiff, which is not the same thing at all as a debt collector- depends which type of bailiff and which type of warrant. At this point I'm going to stop before I get stuck in a loop.

Well a bailiff is either in your house legally, in which case they're all the way in your house (if you see what I mean) or they're not in there legally at all. If you see what I mean. Once they're in the house legally, they can go into any part of it.

This right to force entry has caused immense problems and was provided to bailiffs under Schedule 4A of the Domestic Violence Crimes & Victims Act and allows bailiffs collecting unpaid Magistrates Court Fines to force entry.

If the Ministry of Justice witnessed just 1% of the complaints that we have seen concerning forced entry then I am sure that they would give 2nd thoughts to this awful clause.
