Phoenix recoveries

Hi Everyone,


I'm considering seeking damages from phoenix recoveries as they have recorded a ficticious credit agreement on my file with a default status while the account is in dispute having also failed to provide a CCA (or any proof at all) I just wondered what my legal position was and if anybody knew of a good solicitor to get involved? Ive sent a complaint letter and sent copies to OFT/ FOS/information commisioner and all 3 credit agencies. Does the deformation of character offence still exist?

The account isnt even mine!! ive NEVER EVER had an account with the original creditor

    In the first instance i would contact the CRA's to inform them that this is not your debt. Not that it is in dispute, but that it is not your debt at all.

    It is against the Data Protection Act to hold incorrect information about you and the CRA should hopefully put a note on your credit file and request the DCA to amend their information - which would mean taking the information off your file.

    I would write to Pheonix and request a copy of their official complaints procedure and make an official complaint. If they do not amend your credit file, report them to the Information Commissioner's Office.
