Sue V Barclays Full and Final Settlement

Ok, this is the chronology of my dealings with barclays so far, if anyone has any advice on how to take this forward please post!

7/10/08 - i wrote to them offering £69 on a balance of £126 as full and final settlement
29/10/08 - CDCS Ltd wrote back saying they are prepared, without prejudice, to accept £69 in full and final settlement of the debt' with details of how to pay.

18/11/08 - i wrote back requesting that they confirm this offer will be accepted in full and final settlement, that they or nobody else would pursue me for the remainder and that my credit file is marked as satisfied in full.

3 Feb 09 - CDCS Ltd sent me a 24 hour notice letter saying if i do not make a payment they intend to commence a personal visit to my home and a CCJ against me.

is this a DCA?

i hesitate to ask a silly question but would it be okay to send the cheque without them confirming in writing that i wont be pursued for the remainder and my credit file is marked as satisfied, as i have been waiting for them to confirm this since 18th nov and if they had i would have already sent the cheque! sad.gif i certainly dont want a CCJ or anybody coming to my house!

  • If you've got it in writing that they will accept the pyt as full and final settlement, I would photocopy the letter and send it to them with the payment. If they take it any further after that, you have it in writing that they offered you this. Also make sure to keep any proof of payments.
  • they wrote confirming it is in full and final, BUT they didnt confirm as asked that nobody else would chase me for the reaminder and that my credit file would be marked as satisfied, am wondering whether i need to hold out for that or proceed as it is?
  • does anyone else have experience with this? just want to make sure i do the right thing with it :confused:
  • following another letter from CDCS on behalf of barclays threatening me with DCA again i have sent the following letter, along with a phone harassment letter/:
    WITHOUT PREJUDICE
    I understand that my account with Barclays has been passed to your company to deal with. I write concerning the balance outstanding on the above account and would refer to a letter sent by Barclays dated 14th November 2008, in which they state they are prepared to accept, without prejudice, my offer of £69.56 in full and final settlement of the debt.
    Please can you confirm that Barclays will mark my credit reference file as ‘satisfied in full’ in respect of the above account and remove the defaults which are currently on it also
    I require that you confirm in writing that this sum will be accepted in full and final settlement of this account.
    This offer is made on the understanding that if accepted neither you nor any company associated with you will take any further action to enforce or pursue this debt in any way whatsoever and that I will be released from any liability. I require confirmation that the outstanding balance will not be pursued by any other company now or in the future.
    Payment can be made within fourteen days of receiving your written agreement to this offer.
    I would like to add that if we cannot reach agreement on this I will have no choice but to distribute the funds amongst my other creditors. I am also enclosing a letter to your company regarding harassment and requesting tha t all correspondence in future is conducted in writing only.

  • recieved a letter from BArclays themselves this time that states

    'further to our previous communication the above debt is still outstanding. you have failed to comply with the repayment requests of central debt collection services who were acting on our behalf. if you do not contact us within 7 days your account will be passed to a debt collection agency;

    Any advise on what stpes i should take next? :rolleyes:

  • going round in circles with these people. they have now wrote to me on 3rd march saying they will accept it as full and final settlement. they do not confirm as requested that no other agency will pursue me for the balance or that it will be marked as satisfied on my file - help?

    The 7 day warnings are just an automated letter because their admin dept didn't process your reply quick enough to halt the computer sending the panic letter.

    Still, that's no reason not to phone up and throw a p*ss-fit. :)

    thanks think i will ring them and ask for confirmation in writing as they are being so slow! letters seem to elicit the same response every time and i am not getting anywhere!
