advertising jobs?

Does a company have to advertise a job position that would involve a pay rise?
When ever a position comes avalible, the company I work for always just gives it who ever they like at that time. Rectently, there has been a few positions come up that I am qualified for and easily capable of doing but because I dont suck up to managment like alot of people, I havn't been offered these positions. Iv heard that legally they have to advertise these jobs (even though they already know whos going to get the job)

There is no requirement to advertise jobs. Might be good practice but employers do not have to do so.
Good companies will always appoint the best person for the job - it makes sense to maximise the potential in any role. Attitude is as, if not more important, than qualifications. Being best qualified does not mean you are the best person for the role.0 -
I don't think there is such a law. It's estimated that four-fifths of jobs are never advertised, so if there is most companies break it regularly!
The only exception is the public sector, where I think most if not all jobs do have to be advertised.0 -
Obvious answer - start sucking up to management.0
