Hours OFF before starting new shift

A friend of mine who works for an agency caring for people in their own home has been asked to do a night shift, possibly with an opportunity to sleep, the agency then want her to do her normal day time shift.

She is unsure whether she wants to do this and I think it is probably not legal for her to do this. Can any one give me some guidance on how to advise her?:confused:

Thanks in advance.

The Working Time Regulations say you are entitled to 11 consecutive hours' rest between days of work.

It is not illegal to have less than that but it would not be lawful for an employer to insist upon it.
  • Thank You little Voice,

I will tell her that she should not feel pressured to do this especially as it does seem unreasonable. She worries that if she had an accident driving to her next assignment that she could be criticized by the authorities.

She also worries that she may noi be at her best for her daytime clients.
