Ombudsmans Final Decision

Hi there,

I made my complaint through the Financial Ombudsman and it was upheld, unfortunately, the company concerned have not yet honoured the award which should have been settled by Nov 05.

The Ombudsman have advised me that they have no power to enforce the award and that I need to go through the Courts to have them enforce it, as yet I have not been able to ascertain how I can do this, as the Ombudsman has awarded a calculation and not a figure, so the small claims route does not seem to apply, as it is only for cash amounts only.

Do you have any advice on how I get the award enforced?

What communication have you had with the company, what has been the outcome of these communications?

Could it be that it has been kept at the bottom of somebodys to-do list or whether they are needing to do a complex calculation etc. If you can give some more information and the name of the company, maybe someone will have some expericience in dealing with them.

Contact the FSA and tell them the company is not complying with the ombudsman. The FSA can close a company down for doing that, if they want to.

Thanks for that, the company is Mandrake Associates Ltd of Wisbech, I have sent quite a few letters, faxes and e-mails, only had one reply when I threatened them with Court Action, actually managed to speak to the person handling the file who said it was in a queue. Since then it has been like extracting teeth to get any info.

That company is well known for this and has made the press recently.

From what I have read, they are trying to claim the compensation from a third party rather than pay it themselves. If you do a search on google for them, you will come across a few articles.
