Q for those whos car was not exempt

how long did it take for the company to contact you to either arrange for a third party payment or for the collection.
as i went BR 18 dec i had my OR interview 22dec and the OR said the car is not exempt and will be passing it to a company that will arrange i either get a third party to buy it or i give it to them
i havent heard anything since the OR interview do they have a set time to contact me?? as all it says on the insolvency site is "they act as a matter of urgency"

Not true I am afraid. Its more to do with whether you can convince them you really need it.
I wasn't working, but I did tell them that I really needed it, OH worked and used it and I had depression and it was my lifeline etc....and my car was worth £300 but they took it two days after I went BR."Ginger Rogers did everything Fred Astaire did, except backwards and in high heels"

I have been BR for 1 month, but I still dont know if my car is exempt. I asked the OR who told me I had to speak to the trustee... not done this yet.
My car is work about 2k mark. I do need it for work as i have to leave the office during the day to visit clients. However I know they may say I could catch a bus, this is possible although the boss may not like it as it would work into my work time.
However, may years ago something terrible happened in my life, as a result I will not be alone in the dark, the thought of catching a bus home at 5.30 during the winter in the dark makes me feel sick. I know myself, and I know I would give up work if the bus was my only way to get home, thus reducing the amount of income to our household,
does anyone thing this is a valid reason to keep my car?0 -
hi its only worth about £300-400 i dont use it for work but my nan was down as a dependant. my OR said i would have to get a third party to make an offer or surrender the car and they will send all the details to the company and someone will be contacting me.
but havent heard anything? i just didnt know whever they had a certain time span they had to collect it by as someone said before they have to collect asap just incase i have a crash and wipe the car off then theres nothing for my creditors if they have considered it an asset

this 2k rule hasnt been applying to anyone lately its only really applied if the OR has let you keep the car for work reasons that you do not have to trade in for a cheaper car.
a lady the other day got her £150 car took off her and some have even had there broken cars took so there aint know fixed rule really when it comes to cars
nervousmother could you not provide a doctors letter stating that.
and even if the OR takes the car it doesnt mean you are not allowed to drive one. get a family member/family friend to purchase it. as long as their name is on the reciept its not your car xIf you want to see the rainbow ,you gotta put up with some rain0 -

Lisa, I wouldn't chase them up - unless you have an expense due soon, like MOT/Tax etc as you would be driving illegally without these and its not worth you paying if they are going to take the car.
They are probably holding out in the hope that you call them with an offer - a car valued at £300 is going to realise £100 maximum at auction, and after costs (or taking it and auction etc) they will be well in the red with it, so don't really want to take it unless they have to.
Cars are not just about value. If you need it for work then its essential and needed, but when you are out of work, its just another expense. You OR needs to look at your expenditure and and costs for the car to see if your SOA can cope with them - a £300 car is usually a banger with costly issues!
The way I see it, is that you have 2 choices - either ignore them and wait to see when they come back to you, taking advantage of being able to have the car for the time being - or call them and make an offer of say £50. You can argue that the value of the car less costs to them makes £50 a very good offer in the circumstances, but be prepared to walk away and lose the car (always the key in haggling) - you do not want to pay more than you have to. If they refuse the offer, then tell them you will need to amend your SOA and add £60per month in for bus pass travel and an additional £40 per month for taxis (one return trip per week at £5 per way per week because your doctors are way off the bus route) and add £20 per month to your housekeeping to cover the additional costs for Tesco Home delivery as you cannot get there to buy the food.
(Mind you, its a bit irrelevant. Being on benefits means no IPA anyway, but its the principle of the matter now!)0 -

Lisa, it's very strange they haven't contacted you. The reason it's considered 'a matter of urgency' is that until it's exempt they are responsible for the car and any damage it may cause. For example, if you were to have a crash (god forbid) and wipe out a bus stop and 10 pedestrians the OR would be liable for the lot, which is why they act so fast.
Perhaps someone higher up has told your examiner he's being a @rse but he doesn't want to tell you he's backed down. Just a thought.
Either way you need to know, as it effects your insurance if you needed to make a claim.Accept your past without regret, handle your present with confidence and face your future without fear0 -
thanks peachy thats what i thought that the real OR has red through my forms and i did have that my nan is a dependant and explained why so maybe they have decided that they wont take it.
the other theory is that they are so busy they havent got round to me yet but i red someting about a 42 day rule for something thats an asset i think it post BR new assets im going to try and dig it out and read through thats why i was asking is there a certain amount of time they have to do somethnig about it.

Just read through the stuff on MercMan's link.
The decision process seems to have two stages.
1. Does the BR need a car to carry out their business/occupation? This includes full time unpaid caring.
2. If the BR does need a car, can a reasonable amount be realised from selling it and providing funds for a cheaper car?
If the answer to No.1 is no, they will take the car whatever the value (or offer to sell the BI back to the BR).
If the answer to No2 is yes then it has "excess value" and a maximum figure of £2,000 is advised for the calculations/payment.
It only applies in the case of a car being claimed for excess value, but there is a 42 day notice period.
That's my understanding anyway.
