And having no CCA does give me a bargaining position eg if they start getting heavy without one. And also reassures me about any court action. No CCA etc ...
As I'm sure you're aware of already, Bowells are known for telephone harrassment, making up threats as they go along and disregarding the OFT guidelines. Don't phone them, make sure your letter mentions that you need everything in writing and make sure your number is ex-directory.

Merlin I don't regularly post on here now, I just read. But!

Can you be sure that you have already section 77/78'ed the OC, because if you have then you don't need to do it again. You need to send a nice 'I wish to inoke your complaints procedure because this account is in dispute with the OC' letter. This action should make a DCA go back to the OC to clarify. every time I have sent this type of letter out - the DCA have dropped it like a ton of bricks.

Not having supplied you with a true copy of a fully executed CCA only means that they "have not supplied you with a true copy of a fully executed CCA" not that they haven't got one! I have seen many people over the last year fall down because they have jumped to concluesions.

I would send a letter of complaint to the OC as well, stating that you wish to involk their complaints procedure because they have not supplied a lagitamate request for information, under s77/78 Consumer Credit act 1974 (plus amendments) and that they are breaking the said act and by virtue of the Data protection Act 1980 (plus revisions) are committing an ileagal offence by assigning this account to a debt Collection Agency.

    But again this is me
