more help please!!!!

It is getting very near now to my meeting with the OR - Thursday the 12th to be exact and feeling very nervous - have had quite a few things happen over the last few days and was wondering if anybody can offer any help or advice.
In my previous threads I mentioned about the Halifax saying my account would be ok but as you so rightly explained this was incorrect as it was frozen this week and my wages were still being paid into the account as I have been awaiting account details from both the Barclays Bank account I set up (which to date have received nothing - opening this on the 19th January) - I then went to Co-op and asked to open account with them still awaiting account number and sort code details so I can arrange for payments to be set up etc., and also wages.
When I went into the Halifax they said I could draw out 500 pounds straight away as I was worried about my mortgage payments - drew 600 on the 19th January (the date I went bankrupt) - I was advised from this site that I should not have been given permission to draw this but received an email confirming my account was ok and an overdraft facility was available which again proved to be incorrect as this has now been withdrawn due to account being frozen.
I went to the bank today to draw my wages out to be told I had to contact the OR office which I did and had to go and collect a letter which I duly gave to the Bank and they said I could draw out the past three weeks wages that had been put in since going BR - what is bothering me now is how do I stand with the 600 I drew out on the day I went BR - how will the OR view this? Will I have to repay this money?
I also had an account at work with the Credit Union where monies were being put in although I asked them to stop this when I went BR - I have now been told I have about 100 in this account and they told me draw this money out today as the OR had not been in touch with them - I am so confused I just don't know where I stand - I need to pay my bills but am afraid to use any of the money I get from the bank in case the OR asks for it back when I go on Thursday.
Sorry to go on but just want to make sure I do everything correct - I borrowed some money from a friend a couple of weeks ago to see me through and I was going to pay him back when I got the money out of the bank - would this be allowed as it says you can show preference to a person over your creditors????

    Hi Worried,

You can spend your 3 weeks wages, that's no problem at all, it's your money that you need. It's the £600 o/d you mustn't spend until you've spoken to the OR. Technically as this was taken out once you were BR it isn't included in your BR and you wil be liable to pay it back. However, it is possible, as it was on your BR day that when the OR wrote to the Halifax they included the OD in your BR, only the OR can tell you that.

I'm not sure about the credit union, did you put it on your forms?

  • thanks for that peachy - I put the credit union details on my form but had no money in at the time but my place of work have deducted 30 pounds per week into this account since BR even though I told them to stop it - this is where the money has come from - maybe the OR didnt contact them because there was no money but now there is I assume I leave it until the OR decides to take it or lets me have it - it is very confusing as the OR has not requested my paperwork - I assume I take these with me on Thursday - when my wages went into the Halifax they took monies away to clear the o/d but today they said I would get the full 3 weeks pay so not sure how they will go on about the 600 as this will now show as a debt after BR

Yes, you take your paperwork to your interview. Is it a face-to-face?

The credit union money should be fine, it went in after your BR so the OR has no claim to it, you can carry on saving if you want to, as long as there was nothing in there on BR day.

I think you'll have to wait and see what happens when you go to the Halifax to get your money, if it's less the £600 then that's fine, they've taken it back and you keep the £600 you already have. If they don't take it back, perhaps you can ask if there was any OD on the account went into your BR, they might tell you.

  • Yes I have a face to face interview as I felt more confident seeing them face to face than over the phone as I am not confident on the telephone
The Halifax said I can draw over 700 pounds out which is my wages for the past three weeks - they have not mentioned anything about the 600 pounds - another question please - how long does it take to receive account details from new bank as I have received nothing - rang the co-op up yesterday and they said they had sent them but still haven't received anything?

The post is up the creek with all this snow
They might give you the account number and sort code on the phone.

  • no i asked them but they said they can't give those details over the phone - once I receive the account number and sort code can I then set my account up online so I can keep a check on my account? Does the co-op allow this?

Yes Co-op do online banking. W hen you get your details give them a ring and they will arrange it for you. The only thing I have found is they are slow to update the available balance on line, so watch that.
