To pay or not to pay...

Hi all,
Me and hubby going to court on March 16th to apply for bankruptcy. My question relates to how to pay for court fees. I've read a few posts suggesting not to pay credit cards in order to save money. Other posts suggest withdrawing cash from credit card to pay for fees. We are still meeting min repayments on 3 credit cards, totalling £150 (although only £20 is being paid off balance!).
The bills are likely to land on doormat in next week or so. Shall i just ignore them and draw £150 out of bank and put aside? Will still have to put a large chunk on credit card though.
Another quickie, my take home pay is £700 per month and i don't receive any other income. Am i eligible for the court fee exemption scheme??

  • Yes, stop paying everything (except things like rent, gas, elec, car insurance) and save up your br fee. ORs understand that. Ignore the cc accounts, if they ring, tell them you are going BR, if they are a nuisance change your phone no. If you are paying min then they don't have time to get nasty before the court hearing and will just send letters saying you have missed a payment and will make a charge. Ignore it.

    Yes, draw what money you can out of your bank account, you have to keep yourself going until new bank account can be set up and you need to think of your expenditure over the next couple of months and have everything in cash. It has been known for wages etc to go to an old account and swallowed up in debts/difficult to get back.

    On bank accounts, apply to the co-op get their cashminder and get your wages paid into that as soon as poss. You can tell the OR that this is a new account set up for post BR and is used for your current wages and living expenses. The OR will inform the co-op that they aren't interested in it, and the co-op will be OK with you being bankrupt (only problem is if you have any debts with them in which case Barclays is the other option).

    I felt awful about changing bank accounts, not paying stuff, not making a token payment, but it really is in your interests to help you financially get through the first period when things are being sorted. The co-op no is 08457 240752. Takes about a week to set up,but they should be able to confirm immediately. You will need to take a passport or driving licence into their local bank or via post but that is a formality.

    Yes, if you need money out of the credit cards to pay the court fees, take it. You can explain that to the OR. You have to find the money from some where.

    On £700 a month I would think you can apply for a reduction in the court fee - there is a form to complete, enquire at the court you are getting the forms from.

    If paying ccs on direct debit, cancel that.

    I would not advise telling anyone you owe that you are going bc. They will just increase the phone calls ect in the hope that they will bully you into paying them something. Tell them you are taking advice from either cab,ndl or cccs with the hope of doing a DMP. A porkie i know but the only option really;) .Dx
