Need Help going Bankrupt

Did we get a little sidetracked back there?
Batesy, it's possible but difficult to get help with the OR fee of £310 (you should be remitted the court fee of £150 due to you living at around income support level). Incidentally, you may qualify for a disability premium on income support after 12 months of incapacity, which would lift your total benefits to £80.15 at current rates. There, I'm getting sidetracked too.
Anyway, the two biggest sources of help around my way are EDF (but you must be getting elec/gas from an EDF company and that probably doesn't apply) and the British Legion (ex-forces). I've also seen help given by the Fisherman's Mission (we're talking West Cornwall here). So you need to think about trades that you might have been involved with and ask some questions. The CAB can usually point you in the right direction, and there is a website, which I'll post details of as soon as i remember.
In the meantime the CAB should be offering to contact your creditors with token offers. Are they doing that? And you'll need a new bank account to make that overdraft just another unsecured non-priority debt.
If you keep reading the posts on this site you'll find a lot of info on creditor tactics and how to deal with them. keep asking questions - and welcome to mse!0 -

Is this just speculation or has there been specific proposals for changes to the legislation? the reason i ask is that i'm desparately saving up for BR fees too at the moment!
thanks x
p.s. OP: good luck with the saving! also, have you tried selling stuff on ebay? i dont have any valuable assets either, but managed to raise a few quid by selling small items. Still got a long way to go though...0 -
If you borrow the fees from someone then you can count them as one of your creditors and they will be able to tell you how the case is proceeding via letter the creditor gets from the or.
Has to be a good friend or family member though as the chance of them getting the cash back is remote.

I've just been talking to a Financial Inclusion adviser on this, and apparently there are plans or recommendations to change the legislation so that you don't have to pay a fee to declare, and also so that in at least some cases you wouldn't have to go to court. But i think the actual change is a way off yet.

This new procedure is being called NINA standing for No Income No Assets but it is only at consultation stages so years away.jesster wrote:I've just been talking to a Financial Inclusion adviser on this, and apparently there are plans or recommendations to change the legislation so that you don't have to pay a fee to declare, and also so that in at least some cases you wouldn't have to go to court. Re NINAs (or are they called DROs now?) I've heard 2008 and 2010 mentioned - suspect the latter is more likely so not worth factoring into your plans at the present time.0

Hi,
I have opened another basic account that my benefits go into on the advice of the CAB, and they are supposed to be contacting my creditors and arranging token payments for me, but that was agreed on the 12th December and as yet it doesn't seem that they have done anything as when I get the daily phonecalls from my creditors they are all saying they haven't heard a word from the CAB
This week I got a letter notifying me of imminent court action on my loan (around £5700 that they want straightaway) with the usual threats of bailiff action etc.
My mother is worried because though I own nothing, she thinks that as she has no receipts for the items in the house they may take her stuff, can they do that?
This is all having a negative affect on my health state at the moment, and I'm becoming increasingly dissillusioned with the CAB, as they are appearing to be next to useless.0 -
I would definitely get CAB to do benefit check to see if you can get some more money. You should be able to get the court fee waived as on benefits. I don't know what area you live in but Severn Trent Water have a fund for helping people with cost of applying for bankruptcy - again ask CAB if there is anything like this in your area. I went bankrupt myself a few years ago and while it is still tough to get any kind of decent banking facility (don't want credit anyway!) it was definitely worthwhile as all the pressure is taken off immediately. Good luck0

Did you belong to a union when you were working? Just asking because I know Unison can help with fees.
Also the EOS foundation can help if you are a customer with certain companies. I can't remember which companies but the web address is https://www.eosfoundation.org.uk. (Sorry can't do links) Edit - It's done it for me!!
EOS is run by Charis Grants Ltd - no address for that but you could google it.0
